Criminal law - Robberies - Confession - Whether the majority of the Court of Appeal erred in finding that the trial judge committed reversible error in law in ruling the Respondent’s confession to Cst. Parker voluntary and admissible?
The Respondent was tried on an indictment containing 98 counts with reference to 18 robberies. Convictions were recorded on 92 counts. The Respondent did not challenge the convictions on the counts relating to the robbery of a jewellery store at the Tillicum Mall in Saanich. The last robbery in the series was of Murdoch Jewellers in Surrey. The Respondent confessed to the Murdoch robbery before anything like an inducement came into play, so the appeal from the conviction on the counts related to that incident was dismissed.
The Murdoch robbery occurred on 29 August 2001. Four masked men entered the store and stole $127,400.00 in jewellery at gunpoint. A passer‑by followed them as they made their escape. One of the robbers fired three shots at him from a handgun, a 9mm Glock, later found in the Respondent's trailer, where he lived with Tanya Harrison ("Tanya") and her young son. The Respondent was arrested on 1 September 2001 while driving a black Sunbird convertible registered to Tanya. The car was implicated in a number of other robberies. The police searched the trailer and found jewellery stolen from Murdoch's, as well as the gun. Tanya was also arrested.
The Respondent declined a lawyer and made it clear that he would not provide the additional information unless Tanya was kept out of trouble. Cst. Parker asked the Respondent if Tanya's involvement was only as the driver. The Respondent insisted on a promise that Tanya not be charged and then made repeated demands that he be allowed to speak to her. Cst. Parker disclaimed offering anything that a court might find to be an inducement. He stated that he could not make any deals; that was Crown counsel's decision to make. After the Respondent made a number of admissions, Cst. Parker allowed him to see Tanya. The Respondent returned to the interview and confessed to the balance of the offences.
In his ruling on the voir dire, the trial judge found that the officer did not offer the Respondent an inducement regarding charges against Tanya. In his view, the officer simply outlined the natural consequence of the Respondent's taking responsibility as the primary actor in the robberies. The trial judge acknowledged and Crown counsel conceded that the offer to let the Respondent see Tanya after he "cleared his plate" was an inducement, but he did not think it affected the voluntariness of the statement. The Respondent was convicted on 92 counts. On appeal, the majority of the Court of Appeal allowed the appeal in part and ordered a new trial for counts of all robberies except the Murdoch Jewellers and Saanich/Tillicum Mall robberies. Hall J.A dissenting would have dismissed the appeal.

Droit criminel - Vols qualifiés - Aveu -Les juges majoritaires de la Cour d’appel ont-ils eu tort de conclure que le juge du procès a commis une erreur de droit justifiant annulation en décidant que l’aveu fait par l’intimé à l’agent Parker était volontaire et admissible?
L’intimé a subi son procès sur un acte d’accusation comportant 98 chefs relatifs à 18 vols qualifiés. Il a été déclaré coupable relativement à 92 chefs. L’intimé n’a pas contesté les déclarations de culpabilité prononcées à l’égard des chefs concernant le vol qualifié commis dans une bijouterie du centre commercial Tillicum à Saanich. Le dernier de la série de vols qualifiés a été commis chez Murdoch Jewellers à Surrey. L’intimé a, en l’absence de toute incitation, avoué avoir commis le vol de Murdoch. De ce fait, l’appel interjeté contre la déclaration de culpabilité prononcée à l’égard des chefs relatifs à ce vol a été rejeté.
Le vol de Murdoch a été commis le 29 août 2001. Quatre hommes masqués et armés sont entrés dans le commerce et ont volé des bijoux d’une valeur de 127 400 $. Un passant les suivis au moment où ils s’enfuyaient. L’un des voleurs a fait feu sur lui à trois reprises à l’aide d’un pistolet Glock 9mm, trouvé par la suite dans la roulotte de l’intimé, où celui-ci vivait avec Tanya Harrison (« Tanya ») et son jeune fils. L’intimé a été arrêté le 1er septembre 2001 alors qu’il était au volant d’une Sunbird noire décapotable enregistrée au nom de Tanya. Cette voiture avait été utilisée pour commettre d’autres vols. La police a fouillé la roulotte et a découvert les bijoux volés chez Murdoch, ainsi que le pistolet. Tanya a également été arrêtée.
L’intimé a refusé de retenir les services d’un avocat et a clairement indiqué qu’il ne fournirait les autres renseignements que si Tanya était tenue en dehors de cette histoire. L’agent Parker a demandé à l’intimé si la participation de Tanya se résumait à avoir conduit la voiture. L’intimé a insisté pour qu’on lui promette qu’aucune accusation ne serait portée contre Tanya et a ensuite demandé, à maintes reprises, l’autorisation de lui parler. L’agent Parker a nié avoir fait quoi que ce soit qui puisse être considéré par un tribunal comme une forme d’incitation. Il a affirmé qu’il n’était pas en mesure de marchander et que cette décision relevait du ministère public. Après que l’intimé eut fait un certain nombre d’aveux, l’agent Parker l’a autorisé à voir Tanya. L’intimé est revenu se faire interroger et a avoué avoir commis les autres infractions.
Dans sa décision relative au voir-dire, le juge du procès a conclu que l’agent n’avait fait à l’intimé aucune promesse relativement aux accusations portées contre Tanya. À son avis, l’agent a simplement exposé la conséquence naturelle de la reconnaissance par l’intimé de sa responsabilité en tant qu’auteur principal des vols. Le juge du procès a reconnu, et l’avocat du ministère public a concédé, que l’offre de laisser l’intimé voir Tanya après qu’il se serait « mis à table » était une forme d’incitation, mais il ne croyait pas que cela compromettait le caractère volontaire de la déclaration. L’intimé a été déclaré coupable relativement à 92 chefs. En appel, les juge majoritaires de la Cour d’appel ont accueilli en partie l’appel et ont ordonné la tenue d’un nouveau procès à l’égard de tous les vols qualifiés sauf ceux de Murdoch Jewellers et du centre commercial Tillicum de Saanich. Le juge Hall, dissident, aurait rejeté l’appel.
