L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA031385, 2005 BCCA 285, en date du 20 mai 2005, entendu le 16 octobre 2006, est rejeté. La juge en chef McLachlin et les juges Binnie, LeBel et Abella sont dissidents.
