The appeal from the judgment of the Federal Court of Appeal, Number A‑409‑05, 2006 FCA 1, dated January 6, 2006, heard on February 14, 2007, is allowed with costs throughout on the issue of in rem jurisdiction. The two remaining issues are remitted to the Federal Court of Appeal for consideration.
L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A‑409‑05, 2006 CAF 1, en date du 6 janvier 2006, entendu le 14 février 2007, est accueilli avec dépens dans toutes les cours quant à la question de la compétence en matière réelle. Les deux autres questions en litige sont renvoyées à la Cour d’appel fédérale pour qu’elle les tranche.
