The appeal from the judgment of the Court of Appeal for Ontario, Number C42850, dated November 1, 2005, heard on December 7, 2006 is dismissed, with costs to the respondents payable by Ms. Brooks and not out of the estate. Abella J. is dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C42850, en date du 1er novembre 2005, entendu le 7 décembre 2006 est rejeté avec dépens, ceux‐ci devant être payés aux intimés par Mme Brooks et non par la succession. La juge Abella est dissidente.
