The Czech Republic requests the surrender of the Applicant, Georgios Ganis, for the enforcement of a prison sentence in that country for convictions on charges of procuring women for the purpose of prostitution and being unlawfully at large. The Czech Republic made its request pursuant to an extradition treaty between Canada and Czechoslovakia. The Applicant challenged the Treaty’s existence. Satanove J. concluded that she did not have jurisdiction to inquire into the matter at the committal hearing. The appeal and judicial review were dismissed.

Charte canadienne des droits et libertés - Droit criminel - Extradition - La Cour d’appel a-t-elle commis une erreur en statuant que la question de l’existence d’un traité entre la République tchèque et le Canada ne relevait pas de la compétence du juge d’extradition? - La Cour d’appel a-t-elle conclu à tort que le contrôle judiciaire de la décision d’extrader prise par le ministre ne soulevait pas la question de l’existence d’un traité?
Invoquant un traité d’extradition conclu entre elle et le Canada, la République tchèque a requis que le demandeur, Georgios Ganis, lui soit remis pour purger la peine d’emprisonnement à laquelle il avait été condamné pour proxénétisme et pour avoir été en liberté illégale. Le demandeur a contesté l’existence du traité. La juge Satanove a conclu qu’elle n’avait pas compétence pour examiner cette question lors de l’audience relative à l’incarcération. L’appel et la demande de contrôle judiciaire ont été rejetés.

Taxation — Revocation of pension plan registration — Whether the effective date of a revocation is the date of the related plan’s inception? — Whether the decision to revoke a plan of which the Applicant was a member was made in accordance with the requirements of natural justice? — Income Tax Act, R.S.C. 1985, c. 1 (5th Supp.).
As a result of a complaint from a public servant, the RCMP began an investigation of various pension plans registered under the Income Tax Act (the “Act”). The results of the investigation were shared with the Canada Revenue Agency (the “CRA”). The CRA was informed that members of the Cryptic Web pension plan (the “Plan”) were not employees of Cryptic Web, contrary to a condition of the Plan’s registration under the Act. On the basis of this information, the Plan was revoked. In the interim, the Applicant filed in the Federal Court of Appeal an application seeking to challenge the revocation of Cryptic Web or, in the alternative, to change its effective date of revocation (from the date of Plan’s inception to a later date). In response to a motion brought by the CRA to have the application quashed, the Court concluded that the Applicant had standing to challenge the effective date of revocation of the Plan, but not the decision to revoke. Her application was allowed to proceed on that basis, but was subsequently dismissed. The Court found that the determination of the date at which the Plan had failed to meet the conditions for registration under the Act was essentially one of fact and that the CRA had correctly chosen the date of inception of the Plan as its effective date of revocation.

Droit fiscal — Retrait de l’agrément d’un régime de pension — La date d’effet du retrait est‐elle la date de la création du régime de pension? — La décision de révoquer le régime auquel participe la demanderesse a‐t‐elle été prise conformément aux règles de justice naturelle? — Loi de l'impôt sur le revenu, L.R.C. 1985, ch. 1 (5e suppl.).
Par suite d’une plainte déposée par un fonctionnaire, la GRC a institué une enquête concernant divers régimes de pension agréés en vertu de la Loi de l'impôt sur le revenu (la Loi). La GRC a communiqué les résultats de l’enquête à l’Agence du revenu du Canada (l’ARC). L’ARC a été avisée que, contrairement à l’une des exigences légales relatives à l’agrément des régimes de pension, certains des participants du régime de pension de Cryptic Web (le régime) n’étaient pas des employés de ladite société. Le régime a été révoqué sur la foi de ce renseignement. Entre-temps, la demanderesse a déposé une demande devant la Cour d’appel fédérale visant à contester la révocation du régime ou, à titre subsidiaire, à modifier la date de prise d’effet de la révocation (à une date ultérieure à la date de la création du régime). En réponse à une requête de l’ARC visant à faire annuler la demande de la demanderesse, la Cour a conclu que la demanderesse avait qualité pour contester la date de prise d’effet de la révocation, mais non la décision en tant que telle. Conformément à cette décision, la demanderesse a été autorisée à poursuivre sa demande, mais celle‐ci a été rejetée par la suite. La Cour a conclu que la question de savoir quelle était la date de non‐respect des exigences de la Loi était essentiellement une question de fait et que l’ARC avait eu raison de choisir comme date de prise d’effet de la révocation la date de la création du régime.

Civil procedure - Costs - Whether the appellate court erred in dismissing an appeal of an Order for security for costs - Whether the Applicant should be ordered to pay security for costs in the circumstances of this case.
The Applicant lost her job as a registered medical laboratory technologist with the corporate Respondent. The Applicant made allegations amounting to unjust dismissal and discrimination, and commenced an action in damages asking for $850,000.00, plus an apology. She also filed a complaint with the Manitoba Human Rights Commission. The Respondents claim the Applicant was dismissed because she stopped showing up for work. It defended the action by arguing that the court lacked jurisdiction to hear the matter, given the grievance mechanism available under the collective agreement between the Manitoba Government and General Employees Union and Westman Regional Laboratories Inc. The Applicant was a probationary employee covered by that agreement.

La demanderesse a perdu son emploi de technologue de laboratoire médical autorisée au sein de la société intimée. La demanderesse soutient avoir fait l’objet d’un congédiement injuste et de discrimination, et elle a intenté une action dans laquelle elle réclame des dommages‐intérêts de 850 000 $ et des excuses. Elle a également déposé une plainte auprès de la Commission des droits de la personne du Manitoba. Les intimés soutiennent quant à eux que la demanderesse a été congédiée parce qu’elle avait cessé de se présenter au travail. Ils ont en outre contesté la compétence de la Cour vu la procédure de grief prévue à la convention collective qui lie le gouvernement du Manitoba, le General Employees Union et Westman Regional Laboratories Inc. La demanderesse était une employée à l’essai visée par la convention collective.
