Criminal law (Non Charter) - Evidence - Witnesses - Competency - Spouses - Whether the Court of Appeal erred by holding that spousal testimonial incompetence was a factor under the principled exception to the rule against hearsay which precluded admission in evidence of the pre-trial statements of Darlene Couture because she was married to the Respondent at the time she gave the statements to the police.
The Respondent, David Couture, was convicted of two counts of second degree murder of two young women which occurred in 1986. The wife of the Respondent, Darlene Couture, met the accused who was in prison on other charges in 1989. She married the Respondent in 1996. In 1997, she gave two statements to police regarding disclosures made to her by the accused shortly after they met, and before they were married. At the time of the statements, Mrs. Couture was living separate from her husband; however, they since reconciled and remained married at the time of trial. The trial judge admitted the statements; however, this was overturned by the Court of Appeal. The court ordered a new trial.

Droit criminel (Excluant la Charte) - Preuve - Témoins - Habilité - Conjoints - La Cour d’appel a‑t‑elle commis une erreur en concluant que l’inhabilité du conjoint à témoigner constituait un facteur à considérer selon l’exception raisonnée à la règle du ouï-dire, laquelle interdisait l’admission en preuve des déclarations faites avant le procès de Darlene Couture pour le motif qu’elle était mariée avec l’intimé au moment où elle a fait ces déclarations à la police?
L’intimé, David Couture, a été déclaré coupable de deux chefs d’accusation de meurtre au deuxième degré relativement au meurtre de deux jeunes femmes survenu en 1986. L’épouse de l’intimé, Darlene Couture, a rencontré l’accusé en 1989 alors qu’il était détenu relativement à d’autres accusations. En 1996, elle s’est mariée avec l’intimé. En 1997, elle a fait deux déclarations à la police concernant des révélations que l’accusé lui avait faites peu de temps après qu’ils se soient connus, et avant qu’ils se marient. Au moment des déclarations, Mme Couture était séparée de son mari; ils se sont toutefois réconciliés par la suite et étaient toujours mariés au moment du procès. Le juge du procès a admis les déclarations, décision qui a cependant été infirmée par la Cour d’appel. Cette dernière a ordonné la tenue d’un nouveau procès.
