Les appels interjetés contre les arrêts de la Cour d’appel du Québec (Montréal), numéros 500‐09‐013032‐032, 500‐09‐013033‐030 et 500‐09‐013034‐038, en date du 22 août 2005, entendus le 19 février 2007, sont accueillis, les appels incidents sont rejetés et le jugement de première instance est rétabli. Les dépens devant cette Cour et la Cour d’appel sont accordés au procureur général du Canada.
Les questions constitutionnelles reçoivent les réponses suivantes :
1. Les articles 18, 19, 20, 22, 24 et 25 de la Loi sur le tabac, L.C. 1997, ch. 13, en totalité ou en partie, ou par leur effet combiné, violent-ils l’al. 2b) de la Charte canadienne des droits et libertés?
Réponse : Oui.
2. Dans l’affirmative, cette violation constitue-t-elle une limite raisonnable prescrite par une règle de droit et dont la justification peut se démontrer dans le cadre d’une société libre et démocratique, au sens de l’article premier de la Charte canadienne des droits et libertés?
Réponse : Oui.
3. Les dispositions du Règlement sur l’information relative aux produits du tabac, DORS/2000‐272, qui régissent la taille des messages obligatoires violent-elles l’al. 2b) de la Charte canadienne des droits et libertés?
Réponse : Oui.
4. Dans l’affirmative, cette violation constitue-t-elle une limite raisonnable prescrite par une règle de droit et dont la justification peut se démontrer dans le cadre d’une société libre et démocratique, au sens de l’article premier de la Charte canadienne des droits et libertés?
Réponse : Oui.
The appeals from the judgments of the Court of Appeal of Quebec (Montréal), Numbers 500‐09‐013032‐032, 500‐09‐013033‐030 and 500‐09‐013034‐038, dated August 22, 2005, heard on February 19, 2007, are allowed, the cross-appeals are dismissed and the trial judgment is restored. Costs are awarded to the Attorney General of Canada in this Court and in the Court of Appeal.
The constitutional questions are answered as follows:
1. Do ss. 18, 19, 20, 22, 24 and 25 of the Tobacco Act, S.C. 1997, c. 13, in whole or in part or through their combined effect, infringe s. 2(b) of the Canadian Charter of Rights and Freedoms?
Answer: Yes.
2. If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: Yes.
3. Do the provisions of the Tobacco Products Information Regulations, SOR/2000-272, governing the size of the mandatory messages infringe s. 2(b) of the Canadian Charter of Rights and Freedoms?
Answer: Yes.
4. If so, is the infringement a reasonable limit prescribed by law as can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: Yes.
