The Applicant is being sought in order to stand trial in the US for fraud. On the day that the committal hearing was to begin, the Applicant brought two applications before the extradition judge: an application for an order striking down s. 15 of the Act and quashing the authority to proceed and an application for a writ of habeas corpus with certiorari‑in‑aid.

Accusé de fraude aux États-Unis, le demandeur fait l’objet d’une demande d’extradition afin qu’il soit traduit devant la justice américaine. Le jour où devait débuter l’audience relative à l’incarcération, le demandeur a présenté deux requêtes au juge d’extradition, l’une visant la radiation de l’art. 15 de la Loi, l’autre l’annulation de l’arrêté introductif d’instance et l’obtention d’un bref d’habeas corpus assorti d’un bref de certiorari.
