The appeal from the judgment of the Court of Appeal of Alberta (Edmonton), Number 0403‑0299‑AC, 2006 ABCA 392, dated December 19, 2006, heard on February 22, 2008, is allowed and the order of the chambers judge restored. Each party should bear its own costs in this Court.
