L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A‑527‑05, 2006 CAF 196, en date du 25 mai 2006, entendu le 17 octobre 2007, est accueilli. Le paragraphe 20(2) de la Charte canadienne des droits et libertés oblige la Gendarmerie royale du Canada à fournir ses services dans les deux langues officielles lorsqu’elle joue le rôle d’un service de police provincial dans le cadre de l’entente conclue entre le gouvernement du Nouveau-Brunswick et le gouvernement du Canada en date du 1er avril 1992. Des dépens au montant de 135 000 $ sont accordés aux appelantes.
The appeal from the judgment of the Federal Court of Appeal, Number A‑527‑05, 2006 FCA 196, dated May 25, 2006, heard on October 17, 2007, is allowed. Section 20(2) of the Canadian Charter of Rights and Freedoms requires the Royal Canadian Mounted Police to provide services in both official languages when acting as a provincial police force pursuant to the agreement between the New Brunswick government and the Government of Canada dated April 1, 1992. Costs in the amount of $135,000 should be awarded to the appellants.
