31460 Her Majesty The Queen v. D.B.
Canadian Charter - Criminal - Criminal law - Whether ss. 62, 63, 64(1), 70, 72(1), 75 and 110(2)(b) of the Youth Criminal Justice Act, S.C. 2002, c. 1, are an unjustified infringement of s. 7 of the Canadian Charter of Rights and Freedoms.
The Respondent, aged 17, was at a shopping mall with two friends on December 13, 2003. They met the victim, aged 18, accompanied by his sister and two friends. There was an altercation. The victim and a friend left the mall with the Respondent and his friends in order to fight. While two males wrestled each other to the ground, the Respondent asked the victim if he wanted to fight. The victim declined and continued to observe the fight in progress. The Respondent then “sucker punched” the victim to the neck and face. The victim fell to the ground and the Respondent continued the assault, landing four more punches on the victim’s face and neck. The victim was knocked unconscious and died just past midnight the following day. A post mortem revealed that his death was a direct result of the assault. At the time of the assault, the Respondent was bound by two probation orders.
The Crown sought an adult sentence of five years in light of the seriousness of the offence. The Youth Justice Court concluded that a youth sentence would be sufficient to hold the Respondent accountable for manslaughter. The Youth Justice Court determined that the Youth Criminal Justice Act’s adult sentence and publication presumptions contravened s. 7 of the Charter and were not saved by s. 1. On appeal, the Court of Appeal dismissed the appeal.

Charte canadienne - Affaire criminelle - Droit criminel - Les articles 62, 63, 70 et 75, les par. 64(1) et 72(1) et l’al. 110(2)b) de la Loi sur le système de justice pénale pour les adolescents, L.C. 2002, ch. 1, portent-ils atteinte de façon injustifiée à l’art. 7 de la Charte canadienne des droits et libertés?
Le 13 décembre 2003, l’intimé, âgé de 17 ans, se trouvait dans un centre commercial avec deux amis. Ils y ont rencontré la victime, âgée de 18 ans, qui était en compagnie de sa soeur et de deux amis. Il y a eu altercation. La victime et un ami ont quitté le centre commercial avec l’intimé et ses amis pour se battre. Pendant que deux de leurs comparses tentaient de se renverser l’un l’autre, l’intimé a demandé à la victime si elle voulait se battre. La victime a refusé, continuant d’observer le combat en cours. L’intimé l’a alors frappée « en traître » au cou et au visage. La victime s’est écroulée et l’intimé a continué de la frapper, lui assénant quatre autres coups de poing au visage et au cou. La victime a perdu connaissance; elle est décédée peu après minuit le lendemain. L’autopsie a révélé que les coups avaient été la cause directe du décès. Au moment de l’agression, l’intimé était sous le coup de deux ordonnances de probation.
Le ministère public a demandé qu’une peine de cinq ans, applicable aux adultes, soit infligée en raison de la gravité de l’infraction. Le tribunal pour adolescents a conclu qu’une peine spécifique serait suffisante pour faire répondre l’intimé de l’infraction d’homicide involontaire coupable. Le tribunal a décidé que les dispositions relatives aux sentences applicables aux adultes et à la publication, contenues dans la Loi sur le système de justice pénale pour les adolescents, contrevenaient à l’art. 7 de la Charte et que leur validité n’était pas sauvegardée par l’article premier. La Cour d’appel a rejeté l’appel interjeté par le ministère public.
