The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA033118, 2006 BCCA 391, dated September 7, 2006, heard on February 1, 2008, is allowed with costs in this Court. The trial judge's order that parties shall share equally in any liability related to the reassessment or winding‑up of all tax shelters, with the caveat that this division will be net of any revenue realized in respect of these instruments, should be restored. Abella J. is dissenting.
L'appel interjeté contre l'arrêt de la Cour d'appel de la Colombie‑Britannique (Vancouver), numéro CA033118, 2006 BCCA 391, en date du 7 septembre 2006, entendu le 1er février 2008, est accueilli avec dépens devant notre Cour. Est rétablie l'ordonnance du juge de première instance prévoyant que les parties assumeront à parts égales toute dette découlant d'une nouvelle cotisation relativement aux abris fiscaux ou de leur liquidation, étant entendu que le partage sera effectué après déduction de tout revenu tiré de ces instruments. La juge Abella est dissidente.
