L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Montréal), numéro 500-09-016577-066, en date du 19 octobre 2006, entendu le 27 février 2008, est accueilli. L’arrêt de la Cour d’appel du Québec est cassé et le jugement de la Cour supérieure est rétabli avec dépens dans toutes les cours.
The appeal from the judgment of the Court of Appeal of Quebec (Montréal), Number 500-09-016577-066, dated October 19, 2006, heard on February 27, 2008, is allowed. The decision of the Quebec Court of Appeal is set aside and the judgment of the Superior Court is restored with costs throughout.
