The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA032462, 2007 BCCA 22, dated January 12, 2007, heard on April 25, 2008 is allowed in part, Abella J. dissenting in part. The trial order is reinstated, with the exception of the unfair competition awards against the investment advisors arising out of conduct during the 2.5 week notice period. Costs to follow the event.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA032462, 2007 BCCA 22, en date du 12 janvier 2007, entendu le 25 avril 2008 est accueilli en partie. La juge Abella est dissidente en partie. Le jugement de première instance est rétabli, sauf en ce qui concerne les dommages-intérêts auxquels on été condamnés les conseillers en placements pour concurrence déloyale en raison de leur conduite pendant la période de préavis de deux semaines et demie. Les dépens suivront l’issue de la cause.
