The appeal from the order of the Court of Appeal for Ontario setting aside the respondent's conviction, Number C44993, 2007 ONCA 500, dated July 4, 2007, heard on April 18, 2008, is dismissed and the order is affirmed. Deschamps J. is dissenting.
The cross-appeal against the subsidiary order directing a new trial on the charge of manslaughter by criminal negligence is allowed, and an acquittal is entered. Deschamps J. is dissenting.
L’appel interjeté contre l’ordonnance de la Cour d’appel de l’Ontario annulant la déclaration de culpabilité de l'intimé, numéro C44993, 2007 ONCA 500, en date du 4 juillet 2007, entendu le 18 avril 2008, est rejeté et l'ordonnance est confirmée. La juge Deschamps est dissidente.
L’appel incident à l’encontre de l’ordonnance subsidiaire prescrivant la tenue d’un nouveau procès relativement à l’accusation d’homicide involontaire coupable par négligence criminelle est accueilli, et l’inscription d’un acquittement est ordonnée. La juge Deschamps est dissidente.
