The appeal from the judgment of the Court of Appeal for Ontario, Number C42591, 2007 ONCA 209, dated March 26, 2007, heard on May 14, 2008, is allowed, Deschamps, Charron and Rothstein JJ., dissenting. The judgment of the Court of Appeal is set aside and the trial judgment is restored, with the substitution of March 31, 1995, as the date of commencement of pre-judgment interest. The appellants will have their costs in this Court and in the Court of Appeal. The trial costs will remain as fixed by the trial judge.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C42591, 2007 ONCA 209, en date du 26 mars 2007, entendu le 14 mai 2008, est accueilli, les juges Deschamps, Charron et Rothstein sont dissidents. L’arrêt de la Cour d’appel est annulé et le jugement de première instance est rétabli sauf en ce qui concerne la date à laquelle l’intérêt avant jugement a commencé à courir qui est fixée au 31 mars 1995. Les appelantes ont droit aux dépens devant notre Cour et devant la Cour d’appel. Les dépens adjugés en leur faveur par le juge de première instance demeurent inchangés.
