The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA33390, 2007 BCCA 79, dated February 12, 2007, heard on October 16, 2008, is allowed and the judgment of the trial judge dismissing the respondent’s action is restored, with costs in this Court and in the courts below.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA33390, 2007 BCCA 79, en date du 12 février 2007, entendu le 16 octobre 2008, est accueilli et la décision du juge de première instance rejetant l’action de l’intimée est rétablie, avec dépens devant notre Cour et devant les juridictions inférieures.
