The appeal from the judgment of the Court of Appeal for Saskatchewan, Number 978, 2007 SKCA 66, dated June 14, 2007, heard on December 17, 2008, is dismissed and the order of the Saskatchewan Court of Appeal affirmed.
The constitutional question is answered as follows:
1. Is s. 3 of The Limitation of Actions Act, R.S.S. 1978, c. L‑15 constitutionally inapplicable to the appellant’s claims for personal relief, including damages, reinstatement and other monetary remedies, in an action alleging that s. 98.1(5) of The Workers’ Compensation Act, 1979, S.S. 1979, c. W‑17.1, and related legislation is of no force or effect to the extent that it breaches her rights under the Canadian Charter of Rights and Freedoms?
Answer: No.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Saskatchewan, numéro 978, 2007 SKCA 66, en date du 14 juin 2007, entendu le 17 décembre 2008, est rejeté et l’ordonnance de la Cour d’appel de la Saskatchewan est confirmée.
La question constitutionnelle reçoit la réponse suivante :
1. L’article 3 de The Limitation of Actions Act, R.S.S. 1978, ch. L‑15, est‑il constitutionnellement inapplicable aux réclamations de l’appelante pour une réparation individuelle, y compris des dommages‑intérêts, la réintégration et les autres réparations pécuniaires, dans une action où elle allègue que le par. 98.1(5) de The Workers’ Compensation Act, 1979, S.S. 1979, ch. W‑17.1, et les dispositions législatives connexes sont inopérants dans la mesure où ils violent les droits que lui garantit la Charte canadienne des droits et libertés?
