The appeal from the judgment of the Court of Appeal for British Columbia (Vancouver), Number CA033265, 2007 BCCA 52, dated January 29, 2007, heard on May 15, 2008, is dismissed with costs and the Court of Appeal order is affirmed. The cross‑appeal is allowed with costs and the awards of damages in favour of 636651 B.C. Ltd., Hashka and Backman is set aside, save for the amount of $13.50 payable to Backman.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA033265, 2007 BCCA 52, en date du 29 janvier 2007, entendu le 15 mai 2008, est rejeté avec dépens et l’ordonnance de la Cour d’appel est confirmée. Le pourvoi incident est accueilli avec dépens et les dommages‑intérêts accordés à 636651 B.C. Ltd. et à MM. Hashka et Backman sont annulés, à l’exception des 13,50 $ qui sont payables à M. Backman.
