The appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 0601‑0137‑A, 2007 ABCA 425, dated December 21, 2007, heard on November 20, 2008, is dismissed and the order of the Court of Appeal for a new trial is confirmed, Binnie, Fish and Abella JJ. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Calgary), numéro 0601‑0137‑A, 2007 ABCA 425, en date du 21 décembre 2007, entendu le 20 novembre 2008, est rejeté et l’ordonnance de la Cour d’appel visant la tenue d’un nouveau procès est confirmée. Les juges Binnie, Fish et Abella sont dissidents.
