Administrative law ‑ Regulatory boards ‑ Canadian Radio‑Television and Telecommunications Commission ‑ Jurisdiction and Powers ‑ Appeal by Bell Canada and Telus from CRTC order regarding disposition of funds in deferral accounts held by Bell and Telus for consumer rebates ‑ Whether the Federal Court of Appeal erred in law in determining that the Commission has the jurisdiction to order a rebate of rates determined by it to be just and reasonable on a final basis ‑ Whether the Federal Court of Appeal erred in treating ss. 7 and 47 of the Telecommunications Act as if they were power‑conferring provisions.
Under the February 16, 2006 CRTC Deferral Accounts Decision, the Commission concluded that each incumbent local exchange carrier should use funds in their deferral accounts for initiatives to expand broadband services to rural and remote communities and to improve accessibility to telecommunications services for persons with disabilities. Any accumulated balance remaining in the deferral accounts after these initiatives have been approved by the Commission, were directed to be rebated to the residential local subscribers in non‑high cost service areas. Bell Canada was granted leave to appeal Telecom Decision CRTC 2006‑9, to the extent that it ordered that it must rebate certain amounts in its deferral account. The Federal Court of Appeal dismissed the appeal.

Droit administratif ‑ Organismes de réglementation ‑ Conseil de la radiodiffusion et des télécommunications canadiennes ‑ Compétence et pouvoirs ‑ Appel interjeté par Bell Canada et Telus contre une ordonnance du CRTC sur l’utilisation des fonds cumulés dans les comptes de report détenus par Bell et Telus pour accorder des rabais aux abonnés ‑ La Cour d’appel fédérale a‑t‑elle eu tort de décider que le Conseil a compétence pour ordonner une réduction tarifaire qu’il estime juste et raisonnable en fin de compte? ‑ La Cour d’appel a‑t‑elle eu tort de considérer que les art. 7 et 47 de la Loi sur les télécommunications confèrent des pouvoirs?
Dans sa décision du 16 février 2006 sur les comptes de report, le CRTC a conclu que chaque entreprise de services locaux titulaire doit utiliser les fonds de son compte de report pour financer des initiatives visant à étendre les services à large bande aux collectivités rurales et éloignées et à accroître l’accessibilité des services de télécommunication pour les personnes handicapées. Il a ordonné que les fonds qui restent dans les comptes de report après son approbation de ces initiatives servent à accorder des rabais aux abonnés des services locaux de résidence dans des zones autres que les zones de desserte à coût élevé. Bell Canada a obtenu l’autorisation d’interjeter appel contre la Décision de télécom CRTC 2006‑9, dans la mesure où celle‑ci lui ordonne d’utiliser certaines sommes du compte de report pour accorder des rabais. La Cour d’appel fédérale a rejeté l’appel.
