The appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 0601-0037-AC, 2007 ABCA 198, dated July 27, 2007, heard on February 19, 2009, is allowed with costs in this Court and in the Court of Appeal and the decision of the Court of Queen’s Bench is restored, McLachlin C.J. and Binnie and Fish JJ. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Calgary), numéro 0601-0037-AC, 2007 ABCA 198, en date du 27 juillet 2007, entendu le 19 février 2009, est accueilli avec dépens devant cette Cour et la Cour d’appel et la décision de la Cour du Banc de la Reine est rétablie. La juge en chef McLachlin et les juges Binnie et Fish sont dissidents.
