Criminal law - Defences - Defence of provocation - Air of reality to the defence - Whether the Court of Appeal erred in law in overturning the trial judge’s finding that there was an air of reality to the defence of provocation - Whether the Court of Appeal erred in finding that the trial judge erred in law in the application of the ordinary person test by converting it to a subjective standard - Criminal Code, R.S.C. 1985, c. C-46, s. 232.
The Appellant was charged with second degree murder. The trial judge found that the excuse of provocation was available to the Appellant, and she convicted him of the lesser and included offence of manslaughter. The majority of the Court of Appeal allowed the appeal and entered a conviction of second degree murder on the basis that there was no air of reality to the defence of provocation. Watson J.A., concurring in the result, agreed entirely with the Crown’s position on appeal that the trial judge erred in law in finding that the provocation excuse had been met from both an objective and a subjective perspective. In Watson J.A.’s view, the trial judge was persuaded to apply the words of s. 232 of the Criminal Code “in a discrete manner which caused her to misdirect herself in law as to crucial features of the concepts of ‘insult’ and ‘suddenness’ contemplated by that section.”

Droit criminel - Moyens de défense - Défense de provocation - Vraisemblance du moyen de défense - La Cour d’appel a-t-elle eu tort d’infirmer la conclusion de la juge de première instance selon laquelle la défense de provocation était vraisemblable? - La Cour d’appel a-t-elle eu tort de conclure que la juge de première instance avait commis une erreur de droit dans l’application du critère de la personne ordinaire en le convertissant en norme subjective? - Code criminel, L.R.C. 1985, ch. C-46, par. 232.
L’appelant a été accusé de meurtre au deuxième degré. La juge de première instance a conclu que l’appelant pouvait invoquer l’excuse de provocation et elle l’a déclaré coupable de l’infraction moindre et incluse d’homicide involontaire coupable. Les juges majoritaires de la Cour d’appel ont accueilli l’appel et ont inscrit une déclaration de culpabilité de meurtre au deuxième degré au motif que la défense de provocation était invraisemblable. Le juge Watson, souscrivant au résultat, s’est dit tout à fait d’accord avec la thèse du ministère public en appel selon laquelle la juge de première instance avait commis une erreur de droit en concluant que l’excuse de provocation avait été prouvée, tant sur le plan objectif que sur le plan subjectif. De l’avis du juge Watson, la juge de première instance avait été persuadée d’appliquer les mots de l’art. 232 du Code criminel [traduction] « de manière distincte, ce qui l’a amenée à commettre une erreur de droit quant aux caractéristiques essentielles des notions d’ “insulte” et de caractère “soudain” visées par cet article. »
