The appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 0701-0330-A, 2009 ABCA 276, dated August 21, 2009, heard on May 19, 2010, is allowed and the conviction entered at trial is restored, McLachlin C.J. and Fish J. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Alberta (Calgary), numéro 0701-0330-A, 2009 ABCA 276, en date du 21 août 2009, entendu le 19 mai 2010, est accueilli et la déclaration de culpabilité prononcée au procès est rétablie. La juge en chef McLachlin et le juge Fish sont dissidents.
