The appeal from the judgment of the Court of Appeal for Ontario, Number C49530, 2009 ONCA 794, dated November 12, 2009, heard on December 9, 2010, is allowed in part. The following declarations will issue:
(i) Canada and Ontario have a discretion under the IRPA and its Regulations to defer but not forgive debt after taking into account a sponsor’s submissions concerning the sponsor’s circumstances and those of his or her sponsored relatives.
(ii) Ontario did not improperly fetter its exercise of statutory discretion in adopting its policy. Its terms are consistent with the requirements of the statutory regime and met the legitimate procedural expectations of the respondent sponsors created by the text of their respective undertakings.
(iii) Canada and Ontario owe sponsors a duty of procedural fairness when enforcing sponsorship debt.
(iv) The content of this duty of procedural fairness include the following obligations: (a) to notify a sponsor at his or her last known address of the claim; (b) to afford the sponsor an opportunity within limited time to explain in writing his or her relevant personal and financial circumstances that are said to militate against immediate collection; (c) to consider any relevant circumstances brought to its attention keeping in mind that the undertakings were the essential conditions precedent to allowing the sponsored immigrant to enter Canada in the first place; (d) to notify the sponsor of the government’s decision; (e) without the need to provide reasons.
(v) The above requirements of procedural fairness were met in the cases of the eight respondent sponsors.
All parties will bear their own costs on the appeal and on the application for leave to appeal.
L’appel interjeté contre l’arrêt de la Cour d’appel de l’Ontario, numéro C49530, 2009 ONCA 794, en date du 12 novembre 2009, entendu le 9 décembre 2010, est accueilli en partie. La Cour déclare ce qui suit :
(i) La LIPR et son règlement d’application confèrent au Canada et à l’Ontario le pouvoir discrétionnaire de reporter le recouvrement d’une créance, mais non de remettre une dette, après avoir tenu compte des observations du répondant au sujet de sa situation et de celle de la personne parrainée.
(ii) La politique de l’Ontario n’entrave pas indûment l’exercice de son pouvoir discrétionnaire. Les modalités que la province y établit sont compatibles avec les exigences du régime légal et répondent aux attentes légitimes sur le plan de la procédure créées par le libellé des engagements.
(iii) Le Canada et l’Ontario ont l’obligation de faire preuve d’équité procédurale envers un répondant lorsqu’ils recouvrent une créance de parrainage.
(iv) Cette obligation d’équité procédurale exige : (a) de donner au répondant un avis de la réclamation à sa dernière adresse connue, (b) de lui accorder un délai pour exposer par écrit les circonstances financières ou autres qui militeraient contre le recouvrement immédiat de la créance, (c) de tenir compte de tout élément pertinent qui lui est signalé en se rappelant que l’engagement était au départ la condition préalable essentielle à l’admission au Canada de l’immigrant parrainé, (d) d’informer le répondant de la décision de l’administration, et ce, (e) sans qu’il n’y ait besoin de donner de motifs à l’appui.
(v) Les exigences d’équité procédurale susmentionnées ont été respectées pour les huit répondants intimés.
Toutes les parties supporteront leurs propres frais de justice en appel et à l’étape de la demande d’autorisation d’appel.
