Criminal law ‑ Defences ‑ Provocation ‑ Whether defence of provocation meets air of reality test.
The respondent was convicted of second degree murder in respect of the death of her sister‑in‑law. The majority of the Court of Appeal allowed her appeal and ordered a new trial on the basis that the trial judge had erred in failing to bring s. 232 of the Criminal Code, which sets out the defence of provocation, to the jury’s attention. Rochon J.A., dissenting, would have dismissed the appeal. In his opinion, that defence did not have to be put to the jury, because the evidence did not lend an air of reality to it.

Droit criminel ‑ Moyens de défense ‑ Provocation ‑ Le moyen de défense fondé sur la provocation rencontre‑t‑il le critère de la vraisemblance?
L’intimée est déclarée coupable du meurtre au deuxième degré de sa belle‑sœur. En appel, la majorité de la Cour d’appel accueille l’appel et ordonne la tenue d’un nouveau procès au motif que le premier juge a fait erreur en omettant de porter à l’attention du jury l’art. 232 du Code criminel, soit la défense de provocation. Le juge Rochon, dissident, aurait rejeté l’appel. À son avis, cette défense n’avait pas à être soumise au jury puisque la preuve ne la rendait pas vraisemblable.

Torts - Negligence - Causation - Material contribution test - Whether the Court of Appeal erred in restating and narrowing the material contribution test for causation - If not, whether the material contribution test is available only in circular or dependency causation - Whether the trial judge made a palpable and overriding error in his findings of fact or inferences - Alternatively, whether causation could be found by using the “robust and pragmatic approach” used by Sopinka J. in Snell v. Farrel, [1990] 2 S.C.R. 311.
The appellant was severely injured while riding on a motorcycle driven by her husband, the respondent. The trial judge found that the respondent was negligent in two respects: he was driving at an excessive speed and the motorcycle was overloaded. Applying the material contribution test, he found that causation had been established and that, therefore, the respondent was liable for the injuries sustained by the appellant. The Court of Appeal allowed the respondent’s appeal. It set aside the trial judge’s order and dismissed the appellant’s action.

Responsabilité délictuelle ‑ Négligence ‑ Lien de causalité ‑ Critère de la contribution appréciable ‑ La Cour d’appel a‑t‑elle eu tort de reformuler et de limiter le critère de la contribution appréciable en matière de causalité? ‑ Sinon, peut‑on employer ce critère uniquement en présence de causalité circulaire ou de dépendance? ‑ Le juge de première instance a‑t‑il commis une erreur manifeste et dominante en tirant ses conclusions de faits ou les inférences qui en découlaient? ‑ Subsidiairement, aurait‑il été possible de conclure à un lien de causalité en utilisant l’approche « décisive et pragmatique » à laquelle a recouru le juge Sopinka dans Snell c. Farrel, [1990] 2 R.C.S.. 311.
L’appelante a été grièvement blessée alors qu’elle prenait place sur une motocyclette conduite par son époux, l’intimé. Le juge de première instance a conclu que l’intimé avait été négligent à deux égards : il conduisait à une vitesse excessive et la motocyclette était surchargée. Appliquant le critère de la contribution appréciable, il a conclu que le lien de causalité avait été établi et que l’intimé était donc responsable des blessures subies par l’appelante. La Cour d’appel a accueilli l’appel de l’intimé. Elle a rejeté l’ordonnance du juge de première instance et rejeté l’action de l’appelante.
