Criminal law - Forfeiture of offence‑related property - Factors to be considered by court in deciding not to order forfeiture of offence‑related property - Whether Court of Appeal erred as regards factors that can be considered in balancing exercise used to determine whether impact of order of forfeiture of property other than dwelling‑house is disproportionate under s. 490.41(3) Cr.C. - Criminal Code, R.S.C. 1985, c. C‑46, s. 490.41(3).
The respondent pleaded guilty to two counts of operating a motor vehicle with a blood alcohol level over the legal limit. He had similar prior convictions from 1989, 1982 and 1975. He was sentenced to imprisonment for twelve months on the first count and five months on the second count. He was also prohibited from driving for five years following the end of his period of imprisonment. The Crown applied for forfeiture of the vehicle driven by the respondent at the time of the offence on the ground that it was offence‑related property within the meaning of the Criminal Code. The Court of Québec dismissed the Crown’s motion for forfeiture of the vehicle pursuant to s. 490.41(3) of the Criminal Code, and the Court of Appeal dismissed the Crown’s appeal.

Droit criminel - Confiscation de biens infractionnels - Facteurs à considérer par le tribunal pour ne pas ordonner la confiscation d’un bien infractionnel - La Cour d’appel a‑t‑elle erré quant aux facteurs pouvant être pris en compte dans l’exercice de pondération visant à déterminer si la confiscation d’un bien autre qu’une maison d’habitation est ou non démesurée suivant le paragraphe 490.41 (3) C.cr.? - Code criminel, L.R.C. 1985, ch. C‑46, art. 490.41(3).
L’intimé plaide coupable à deux infractions d’avoir conduit un véhicule à moteur alors que son taux d’alcoolémie dans le sang dépassait la limite permise. L’intimé a déjà des antécédents judiciaires en semblable matière remontant à 1989, 1982 et 1975. Il est condamné à douze mois de prison pour la première infraction et cinq mois de prison pour la deuxième, ainsi qu’à une interdiction de conduire de cinq ans à compter de la fin de la période d’emprisonnement. Le ministère public demande que le véhicule de l’intimé conduit lors de l’infraction soit confisqué au motif qu’il s’agit d’un bien infractionnel au sens du Code criminel. La Cour du Québec rejette la requête pour confiscation de véhicule du ministère public, en application de l’art. 490.41(3) du Code criminel et la Cour d’appel rejette l’appel du ministère public.

Criminal law ‑ Offences ‑ Elements of the offence ‑ Uttering threats ‑ Mens rea requirement ‑ Whether the Court of Appeal erred in assessing the mens rea requirement for the offence of uttering threats ‑ Whether the Court of Appeal erred in finding that the evidence of the complainant was the determinative factor in the analysis of the mens rea requirement for uttering threats ‑ Criminal Code, R.S.C. 1985, c. C‑46, s. 264.1(1)(a).
The respondent was acquitted on two counts of uttering threats and two counts of breach of probation. While incarcerated, he threatened by telephone to kill his girlfriend if she aborted their child. The complaint was made by the staff of the correctional centre. When called to testify, the girlfriend explained that the respondent’s words did not cause her any fear and that he was just being loud and belligerent with her. The Crown appealed the acquittals on two grounds. First, it argued that in her assessment of the mens rea of the offence, the trial judge erred by relying exclusively on the girlfriend’s evidence. In the Crown’s view, the trial judge ought to have looked at whether a reasonable person, thinking objectively, would have considered the words to be a threat. Second, the Crown argued that in the absence of testimony from an accused, the question of whether he had the intention to intimidate will usually be determined by the words used, the context in which they were used and the person to whom they were directed. The Crown submitted that the trial judge failed to do so in this case. The majority of the Court of Appeal dismissed the appeal. Steel J.A., dissenting, would have allowed the appeal on the basis that the trial judge erred with respect to the legal effects of the girlfriend’s evidence as it related to the mens rea requirement for uttering threats.

Droit criminel ‑ Infractions ‑ Éléments de l’infraction ‑ Profération de menaces ‑ Exigence de la mens rea ‑ La Cour d’appel a‑t‑elle mal évalué la mens rea requise pour l’infraction de proférer des menaces? ‑ La Cour d’appel a‑t‑elle conclu à tort que le témoignage de la plaignante était déterminant dans l’analyse de la mens rea requise pour la profération de menaces? ‑ Code criminel, L.R.C. 1985, ch. C‑46, art. 264.1(1)a).
L’intimé a été acquitté relativement à deux chefs de profération de menaces et à deux chefs de violation des conditions de probation. Durant son incarcération, il a menacé au téléphone sa petite amie de la tuer si elle avortait leur enfant. La plainte de menace a été déposée par le personnel du centre correctionnel. Appelée à témoigner, la petite amie a expliqué que les paroles de l’intimé ne l’avaient aucunement effrayée et qu’il ne faisait que parler fort et se montrer agressif envers elle. Le ministère public a interjeté appel des acquittements pour deux raisons. Il a soutenu d’abord que, dans son évaluation de la mens rea de l’infraction, la juge du procès avait fait erreur en s’appuyant exclusivement sur le témoignage de la petite amie. Selon le ministère public, la juge du procès aurait dû se demander si une personne raisonnable aurait considéré objectivement les paroles comme une menace. Le ministère public a également soutenu que, si un accusé ne témoigne pas, la question de savoir s’il avait l’intention d’intimider sera habituellement tranchée en fonction des mots utilisés, du contexte dans lequel ils s’inscrivent et de la personne à qui ils étaient destinés. Toujours selon le ministère public, la juge du procès n’a pas procédé à cette analyse en l’espèce. Les juges majoritaires de la Cour d’appel ont rejeté l’appel. La juge Steel, dissidente, aurait accueilli l’appel parce que la juge du procès s’est trompée quant aux effets juridiques du témoignage de la petite amie relatif à la mens rea requise pour la profération de menaces.
