The appeal from the judgment of the Federal Court of Appeal, Number A-76-11, 2012 FCA 122, dated April 25, 2012, heard on October 10 and 11, 2013, is allowed in part, Abella and Cromwell JJ. dissenting in part. The cross-appeal is dismissed. The IRPA scheme is constitutional. The designated judge’s conclusion that the security certificate was reasonable is reinstated.

 

L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéro A-76-11, 2012 CAF 122, en date du 25 avril 2012, entendu les 10 et 11 octobre 2013, est accueilli en partie. Les juges Abella et Cromwell sont dissidents en partie. L’appel incident est rejeté. Le régime instauré par la LIPR est constitutionnel. La conclusion du juge désigné selon laquelle le certificat de sécurité était raisonnable est rétablie.
