Coram: McLachlin C.J. and Abella, Rothstein, Cromwell, Moldaver, Karakatsanis and Wagner JJ.
The appeal from the judgment of the Court of Appeal of New Brunswick, Number 161-11-CA, 2013 NBCA 27, dated April 25, 2013, heard on May 12, 2014, is allowed with costs throughout, the Court of Appeal’s judgment is set aside and Mr. Potter’s action for constructive dismissal is allowed. Mr. Potter is entitled to damages for wrongful dismissal as assessed by the trial judge, with the exception that the pension benefits Mr. Potter has already received are not to be deducted from those damages.
L’appel interjeté contre l’arrêt de la Cour d’appel du Nouveau-Brunswick, numéro 161-11-CA, 2013 NBCA 27, en date du 25 avril 2013, entendu le 12 mai 2014, est accueilli avec dépens devant toutes les cours, le jugement de la Cour d’appel est infirmé et l’action pour congédiement déguisé est accueillie. M. Potter a droit aux dommages-intérêts pour congédiement injustifié établis par le juge de première instance, mais les prestations de retraite déjà touchées par M. Potter ne doivent pas en être déduites.
