The Respondent was charged on April 19, 1995 with two counts of break and enter. He appeared before Plamondon J. on April 24, 1995 and entered a plea of guilty to both charges. A pre-sentence report was requested and the matter was adjourned for sentencing. In the interim, Plamondon J. became ill, and the case was adjourned indefinitely. On April 15, 1996, Plamondon J. resigned his position. On May 22, 1996, the case was assigned to Fitzgerald J. On September 24, 1996, Fitzgerald J. granted the Respondent’s application for a stay of proceedings.
The Appellant’s appeal to the Court of Appeal was dismissed.

Le 19 avril 1995, l’intimé a été inculpé sous deux chefs d’accusation d’introduction par effraction. Il a comparu devant le juge Plamondon le 24 avril 1995 et a plaidé coupable aux deux chefs. Un rapport présentenciel a été demandé et l’affaire a été ajournée aux fins de la détermination de la peine. Entre-temps, le juge Plamondon est tombé malade et l’affaire a été ajournée indéfiniment. Le 15 avril 1996, le juge Plamondon a démissionné de sa charge. Le 22 mai 1996, l’affaire a été confiée au juge Fitzgerald. Le 24 septembre 1996, le juge Fitzgerald a accueilli la demande d’arrêt des procédures de l’intimé.
L’appel de l’appelante a été rejeté.

The Respondent was charged on December 2, 1994 with one count of indecent assault alleged to have been committed in 1973. The Respondent appeared in Provincial Court on February 13, 1995 before Plamondon J., and entered a plea of not guilty. On April 5, 1995, the Respondent changed his plea to guilty, and a pre-sentence report was requested. On July 14, 1995, the case was adjourned indefinitely because Plamondon J. was ill. On April 15, 1996, Plamondon J. resigned his position. On May 22, 1996, the case was assigned to Fitzgerald J. to preside at the sentencing hearing. On September 24, 1996, Fitzgerald J. granted the Respondent a stay of proceedings due to an alleged violation of s. 11(b) of the Charter.
The Appellant’s appeal to the Court of Appeal was dismissed.

L’intimé a été accusé le 2 décembre 1994 sous un chef d’attentat à la pudeur qui aurait été commis en 1973. L’intimé a comparu en Cour provinciale le 13 février 1995 devant le juge Plamondon et a inscrit un plaidoyer de non-culpabilité. Le 5 avril 1995, l’intimé a remplacé son plaidoyer par un plaidoyer de culpabilité, et un rapport présentenciel a été demandé. Le 14 juillet 1995, l’affaire a été ajournée indéfiniment parce que le juge Plamondon était malade. Le 15 avril 1996, le juge Plamondon a démissionné de ses fonctions. Le 22 mai 1996, le dossier a été confié au juge Fitzgerald pour qu’il préside l’audience pour la détermination de la peine. Le 24 septembre 1996, le juge Fitzgerald a accordé à l’intimé un arrêt des procédures à cause d’une violation alléguée de l’al. 11b) de la Charte.

25355 DANCORP DEVELOPMENTS LTD. v. METROPOLITAN TRUST COMPANY OF CANADA AND DUNWOODY LIMITED
Commercial law - Creditor and debtor - Interest - Criminal rate of interest - Whether criminal rate of interest under Criminal Code s. 347(1)(b) is to be calculated by reference to the date the loan was repaid in full or by reference to the contractual term of the loan.
The Appellant was involved in the construction of a condominium project in which it had arranged financing by way of a first mortgage from the Respondent in the amount of approximately $16 million. The Appellant entered into a construction agreement with Degelder Construction for the construction of the project. The terms of the presale contracts required completion of the project by December 31, 1990. In the late summer of 1989, a design defect was discovered requiring the project to be demolished and rebuilt. The Respondent refused to advance further funds under the first mortgage until the Appellant had satisfied it that it was capable of finishing the project within the financial limitations of the first mortgage. In January 1990, a second mortgage loan was entered into which involved bonuses and number of other charges in addition to interest at prime plus 2 percent.
In early 1990, the Appellant was under increasing pressure to accelerate the project to ensure completion by December 31, 1990. An agreement was signed in January between the Appellant, Respondent and Degelder in which the Respondent had the right to order acceleration of the project. In October 1990, the Respondent entered into a letter agreement with Degelder concerning acceleration of construction and in December entered into an agreement to have Tower I completed to the occupancy level within 4 days. The Appellant was of the opinion that both agreements were not authorized by the loan agreements. The Appellant advised the Respondent that it was to consider itself a mortgagee in possession of the project. On December 24, 1990, the Respondent served notice on the Appellant requiring payment of the balance due under the mortgages by December 27, 1990. Late in the afternoon of that day, the Respondent placed a receiver in charge of the project. The second mortgage loan was repaid on January 29, 1993.
Degelder brought an action against the Appellant, the Respondent and several other defendants. The Appellant sought summary judgment of its claim against the Respondent. Preston J. rejected the Appellant’s claim that the Respondent had received criminal interest. On appeal, the Court of Appeal dismissed the appeal.

L’appelante s’était engagée dans un projet de construction de condominiums. Elle en avait arrangé le financement en accordant une première hypothèque à l’intimée au montant d’environ 16 millions de dollars. L’appelante a conclu une entente de construction avec Degelder Construction pour la réalisation du projet. Les stipulations des contrats de prévente exigeaient l’achèvement du projet pour le 31 décembre 1990. Vers la fin de l’été 1989, un défaut de conception a été découvert qui a exigé la démolition et la reconstruction des condominiums. L’intimée a refusé d’avancer d’autres sommes en contrepartie de la première hypothèque jusqu’à ce que l’appelante l’ait convaincue qu’elle était capable de finir le projet dans les limites financières de la première hypothèque. En janvier 1990, une deuxième hypothèque a été conclue et elle comportait des primes et de nombreuses autres obligations en plus d’un intérêt fixé à un taux de 2 p. 100 supérieur au taux préférentiel.
Au début de 1990, des pressions de plus en plus grandes s’exerçaient sur l’appelante pour que la construction soit terminée pour le 31 décembre 1990. Une entente a été conclue en janvier entre l’appelante, l’intimée et Degelder, en vertu de laquelle l’intimée obtenait le droit d’ordonner l’accélération des travaux. En octobre 1990, l’intimée a signé une lettre d’entente avec Degelder concernant l’accélération des travaux et, en décembre, elle a conclu une entente où elle obtenait que les travaux sur la Tour I soient, dans un délai de 4 semaines, dans un état d’achèvement suffisant pour en permettre l’occupation. L’appelante était d’avis que les contrats de prêt ne permettaient pas la conclusion des deux ententes. L’appelante a informé l’intimée qu’elle devait se considérer comme créancier hypothécaire en possession de l’ouvrage. Le 24 décembre 1990, l’intimée a signifié à l’appelante qu’elle exigeait le paiement du solde dû en vertu des hypothèques pour le 27 décembre 1990. En fin d’après-midi ce jour-là, l’intimée a confié à un séquestre la responsabilité du projet. Le deuxième prêt hypothécaire a été remboursé le 29 janvier 1993.
Degelder a intenté une action contre l’appelante, l’intimée et plusieurs autres défendeurs. L’appelante a cherché à obtenir un jugement sommaire quant à sa réclamation contre l’intimée. Le juge Preston a rejeté la réclamation de l’appelante selon laquelle l’intimée avait perçu un intérêt à un taux criminel. La Cour d’appel a rejeté l’appel.

(4th) 139 (B.C.C.A.), aff’d [1986], 1 S.C.R. 749 - Whether the late payment penalties charged by the Respondent fall under s.347 of the Criminal Code, R.S.C. 1985, c. C-46 - Whether the $500 costs award made against the Appellant is valid.
The Appellant became a customer of the Respondent in 1983 and has paid approximately $75 in late payment penalties. The Appellant commenced an action for the restitution of some $112 million in Late payment penalties alleged to have been paid by customers of the Respondent since April 1, 1991. The action was commenced as a class action, but the class has not yet been certified.
The Respondent’s affairs are regulated by the Ontario Energy Board (OEB) pursuant to the Ontario Energy Board Act, R.S.O. 1990, c. O-13 and the Municipal Franchises Act, R.S.O. 1990, c. M-55. The Respondent cannot, by virtue of the OEB Act, sell its gas except in accordance with an order of the OEB. As such, the OEB has specifically approved the Respondent’s late payment policy. That policy provides that bills for residential customers not paid by the due date will be subject to a penalty of 5% of the unpaid amount. The due date is 10 or 16 days from the date the bill was mailed, depending on the account category. The late payment penalty is a one-time charge and is not compounded.
The Appellant alleged that the late payment penalty results in a criminal rate of interest under s.347 of the Criminal Code. Section 347 came into force in 1981. The Respondent’s motion for summary judgment was granted. The Court of Appeal dismissed the Appellant’s appeal.

L'adjudication de dépens de 500 $ contre l'appelant est-elle valide?
L'appelant est devenu client de l'intimée en 1983 et a versé environ 75 $ de pénalités pour paiement en retard. L'appelant a intenté une action en remboursement de quelque 112 millions de dollars de pénalités pour paiement en retard que des clients de l'intimée auraient versés depuis le 1er avril 1991. L'action a été intentée à titre de recours collectif, mais le statut de recours collectif n'a pas encore été confirmé.
Les affaires de l'intimée sont régies par la Commission de l'énergie de l'Ontario (CEO) en application de la Loi sur la Commission de l'énergie, L.R.O. 1990, ch. O-13, et de la Loi sur les concessions municipales, L.R.O. 1990, ch. M-55. En vertu de la Loi sur la CEO, l'intimée ne peut vendre de gaz si ce n'est en conformité avec une ordonnance de la CEO. La CEO a donc spécifiquement approuvé la politique de paiement en retard de l'intimée. Suivant cette politique, les factures des clients résidentiels non payées à échéance sont assujetties à une pénalité de 5 % du montant impayé. Suivant la catégorie de compte, la date d'échéance est fixée à 10 ou 16 jours de la date de mise à la poste de la facture. La pénalité pour paiement en retard n'est exigée qu'une seule fois et il n'y a pas pénalité sur la pénalité impayée.
L'appelant a allégué que la pénalité pour paiement en retard produit un taux d'intérêt criminel au sens de l'art. 347 du Code criminel. L'article 347 est entré en vigueur en 1981. La requête en jugement sommaire présentée par l'intimée a été accueillie. La Cour d'appel a rejeté l'appel interjeté par l'appelant.
