The appeal is dismissed with costs.  All of the assessments are referred back to the Minister of National Revenue for reconsideration and reassessment in accordance with the reasons of the majority.

 

Le pourvoi est rejeté avec dépens.  Toutes les cotisations sont renvoyées au ministre du Revenu national pour réexamen et établissement d’une nouvelle cotisation en conformité avec les motifs de la majorité.

The appeal is allowed with costs and the assessment is referred back to the Minister of National Revenue for reconsideration and reassessment in accordance with the reasons of the majority, L’Heureux-Dubé and Bastarache JJ. dissenting.
