The appeal is allowed and the matter is returned to the Convention Refugee Determination Division of the Immigration and Refugee Board for consideration under Article 33 of the Convention Relating to the Status of Refugees, and ss. 19 and 53 of the Immigration Act, if the respondent chooses to proceed.  Cory and Major JJ. are dissenting.

 

Le pourvoi est accueilli et l’affaire est renvoyée à la Section du statut de réfugié de la Commission de l’immigration et du statut de réfugié pour examen sous le régime de l’article 33 de la Convention relative au statut des réfugiés et des art. 19 et 53 de la Loi sur l’immigration, si l’intimé choisit d’aller plus loin.  Les juges Cory et Major sont dissidents.
