The judgments below are set aside and s. 68 of The Correctional Services Regulations, 2013, R.R.S., c. C‑39.2, Reg. 1, is declared to be of no force or effect under s. 52(1) of the Constitution Act, 1982. Côté, Rowe and Jamal JJ. dissent.

C‑39.2, Reg. 1, est déclaré inopérant suivant l’art. 52 de la Loi constitutionnelle de 1982. Les juges Côté, Rowe et Jamal sont dissidents.
