The appeal from the judgment of the Court of Appeal of Newfoundland and Labrador, Numbers 2020-01H-0073 and 2020-01H-0067, 2023 NLCA 22, dated August 14, 2023, heard on April 15 and 16, 2025, is allowed in part. The Court of Appeal’s order dismissing the appeal as moot is set aside. The order of the application judge is modified to reflect that the travel restrictions at issue limited the appellant Kimberley Taylor’s mobility rights as guaranteed by s. 6(1) and (2) of the Canadian Charter of Rights and Freedoms. This limit was justified under s. 1 of the Charter. Wagner C.J. and Rowe, Kasirer and Jamal JJ. dissent in part.

L’appel interjeté contre l’arrêt de la Cour d’appel de Terre-Neuve-et-Labrador, numéros 2020-01H-0073 et 2020-01H-0067, 2023 NLCA 22, daté du 14 août 2023, entendu les 15 et 16 avril 2025, est accueilli en partie. L’ordonnance de la Cour d’appel rejetant le pourvoi au motif qu’il était théorique est écartée. L’ordonnance du juge saisi de la demande est modifiée afin d’indiquer que les restrictions de déplacement en question limitaient la liberté de circulation de l’appelante Kimberley Taylor que lui garantissent les par. 6(1) et (2) de la Charte canadienne des droits et libertés. Cette limite était justifiée au regard de l’article premier de la Charte. Le juge en chef Wagner et les juges Rowe, Kasirer et Jamal sont dissidents en partie.
