CORAM: The Chief Justice and L'Heureux-Dubé, Gonthier, Cory, McLachlin,
Iacobucci, Major, Bastarache and Binnie JJ.
The appeal is dismissed and no order is made as to costs. The constitutional questions are answered as follows:
Question 1: Do ss. 44(1)(d) and 58 of the Canada Pension Plan, R.S.C., 1985, c. C-8, infringe on s. 15(1) of the Canadian Charter of Rights and Freedoms on the ground that they discriminate against widows and widowers under the age of 45 on the basis of age?
Answer: No.
Question 2: If so, can this infringement be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: In view of the answer to Question 1, it is not necessary to answer this question.
Le pourvoi est rejeté. Aucune ordonnance n’est rendue à l’égard des dépens. Les questions constitutionnelles reçoivent les réponses suivantes:
Question 1: L’alinéa 44(1)d) et l’art. 58 du Régime de pensions du Canada, L.R.C. (1985), ch. C-8, violent-ils le par. 15(1) de la Charte canadienne des droits et libertés pour le motif qu’ils établissent une distinction fondée sur l’âge relativement aux veuves et aux veufs âgés de moins de 45 ans?
Réponse: Non.
Question 2: Dans l’affirmative, la justification de cette violation peut-elle se démontrer dans le cadre d’une société libre et démocratique, au sens de l’article premier de la Charte canadienne des droits et libertés?
Réponse: Vu la réponse donnée à la première question, il n’est pas nécessaire de répondre à cette question.

The appeal is dismissed. As this appeal was resolved without reference to the Constitution Act, 1982, the constitutional question need not be answered.

The appeal is allowed with costs throughout, the judgment of the Court of Appeal is set aside, and the matter is remitted to the trial judge for assessment in conformity with the reasons for judgment of the quantum of the award on the basis that the appellant is legally eligible for post-marital support.
Le pourvoi est accueilli avec dépens dans toutes les cours, l’arrêt de la Cour d’appel est annulé et l’affaire est renvoyée au juge de première instance pour qu’il évalue, conformément aux motifs de jugement, le quantum des versements à accorder en matière d’aliments après le mariage en tenant pour acquis que l’appelante y est légalement admissible.

Subject to this direction the order of the British Columbia Court of Appeal is affirmed and this appeal is dismissed without costs, Lamer C.J. and Major and Binnie JJ. dissenting.
Les scellés et l’ordonnance de non‐publication sont levés, sauf ce qui concerne les parties de l’affidavit du Dr Smith qui ne sont pas visées par l’exception relative à la sécurité publique. Sous réserve de cette directive, l’ordonnance de la Cour d’appel de la Colombie‐Britannique est confirmée et le présent pourvoi est rejeté sans dépens.
