The appeal is allowed with costs, and the Referee is directed to calculate the amount of compensation required to restore to the respondents what they have lost as a result of the appellants’ breach of confidence. The period of calculation is to be the 12-month period commencing April 15, 1983. The award will carry pre-judgment interest from the dates of the losses (if any), and post-judgment interest. Table rates under the Court Order Interest Act, R.S.B.C. 1996, c. 79, will be used where applicable, or otherwise at two percent under banker’s prime. The appellants will have their costs in this Court. In light of the history of divided success in the litigation, the respondents are to have their costs in the Court of Appeal at Level 2, as ordered by that court, and the costs of the trial are to be referred to the trial court for disposition. The cross-appeal is dismissed with costs.
Le pourvoi est accueilli avec dépens, et il est ordonné à l’arbitre de calculer le montant de l’indemnité requise pour que les intimées puissent récupérer ce qu’elles ont perdu par suite de l’abus de confiance des appelants. Le calcul portera que sur la période de 12 mois commençant le 15 avril 1983. L’indemnité accordée comprendra l’intérêt avant jugement à partir de la date des pertes (s’il y en a), et l’intérêt postérieur au jugement. Le taux utilisé sera celui prévu par le barème établi dans la Court Order Interest Act, R.S.B.C. 1996, ch. 79, lorsqu’il s’applique, ou un taux de 2 pour 100 inférieur au taux préférentiel des banques. Les appelants ont droit à leur dépens devant notre Cour. Étant donné que les parties ont eu tour à tour gain de cause au cours du présent litige, les intimées ont droit à leurs dépens devant la Cour d’appel au second niveau, comme l’a ordonné cette cour, et la question des dépens du procès doit être renvoyée au tribunal de première instance pour qu’il prenne une décision à ce sujet. Le pourvoi incident est rejeté avec dépens.
