The appeal is allowed. The 18-month sentence of incarceration imposed by the trial judge is restored. Given that the respondent has already served the conditional sentence imposed by the Court of Appeal in its entirety, and that the Crown stated in oral argument that it was not seeking further punishment, the service of the sentence of incarceration is stayed.
Le pourvoi est accueilli. La peine de 18 mois d’incarcération infligée par le juge du procès est rétablie. Étant donné que l’intimé a déjà purgé entièrement la peine d’emprisonnement avec sursis infligée par la Cour d’appel et que le ministère public a concédé au cours des plaidoiries qu’il ne sollicitait pas de sanction additionnelle, le sursis à l’exécution de la peine d’incarcération est ordonné.

The appeal is allowed, Lamer C.J. and Iacobucci J. dissenting. The six-month conditional sentence imposed by the Court of Appeal for the sexual assault is set aside. The one-year sentence of incarceration imposed by the trial judge is restored, to be followed by a three-month conditional sentence for the common assaults and three years’ probation imposed by the trial judge for the sexual assault.
Le pourvoi est accueilli, le Juge en chef et le juge Iacobucci sont dissidents. La peine d’emprisonnement avec sursis de six mois infligée par la Cour d’appel pour l’agression sexuelle est annulée. La peine d’un an d’incarcération prononcée par le juge Schwartz à l’égard de cette infraction est rétablie. Cette peine sera suivie d’un emprisonnement avec sursis de trois mois pour les voies de fait simples et de la période de probation de trois ans imposée par le juge du procès pour l’agression sexuelle.

The appeal is allowed. The nine-month sentence of incarceration imposed by the trial judge is restored. Given the fact that the respondent has already served his conditional sentence in its entirety, and that the Crown is not seeking any further punishment, the service of the sentence of incarceration is stayed. The probation order should remain in force.
Le pourvoi est accueilli. La peine d’incarcération de neuf mois infligée par le juge du procès est rétablie. Étant donné que l’intimé a déjà purgé entièrement sa peine d’emprisonnement avec sursis et que le ministère public ne demande pas de sanction additionnelle, le sursis à l’exécution de la peine d’incarcération est ordonné. L’ordonnance de probation devrait demeurer en vigueur.
