Statutes - Interpretation - Statutory instrument - Irrigation canal constructed across a portion of Reserve - Federal Order-in-Council 1957-577 - Whether s. 35 of the Indian Act authorizes the extinguishment of the aboriginal interest and removal of lands from the Reserve - Alternatively, if the Governor in Council can exercise the discretion conferred by s. 35 of the Act to remove the Indian interest of the Band in their reserve land, what principles control the exercise of such discretion - Whether s. 35 of the Act authorizes the removal of the Land from the Reserve through the vehicle of Order-in-Council 1957-577.
In 1957, the Governor in Council enacted an Order-in-Council which recited that the Minister of Agriculture of British Columbia had applied for certain lands that were part of an Indian reserve for the purposes of an existing irrigation canal. Pursuant to s. 35(3) of the Indian Act, the Order-in-Council consented to the taking of the land by the province and “to transfer the administration and control thereof” to the Crown in right of the province. The Town of Oliver operates and maintains the canal.
In 1996, the Appellant enacted property assessment and property taxation bylaws pursuant to s. 83 of the Indian Act. On a case stated by the Osoyoos Indian Band Board of Review, the Chambers Judge concluded that the lands were not assessable by the Appellant. A majority of the Court of Appeal dismissed the Appellant’s appeal.

Lois - Interprétation - Texte réglementaire - Canal d’irrigation aménagé sur une partie de la réserve - Décret fédéral 1957-577 - L’article 35 de la Loi sur les Indiens permet-il l’extinction du droit ancestral et la suppression de certaines terres de la réserve? - Subsidiairement, si le gouverneur en conseil peut exercer le pouvoir discrétionnaire qui lui est conféré par l’art. 35 de la Loi pour supprimer le droit ancestral que possède la bande sur le territoire de leur réserve, à quels principes est assujetti l’exercice d’un tel pouvoir discrétionnaire? - L’article 35 de la Loi autorise-t-il la suppression de cette terre de la réserve par l’entremise du décret 1957-577?
En 1957, le gouverneur en conseil a pris un décret dans lequel il était annoncé que le ministre de l’Agriculture de la Colombie-Britannique demandait que certaines terres situées sur une réserve indienne soient affectées à l’utilisation d’un canal d’irrigation existant. En vertu du par. 35(3) de la Loi sur les Indiens, le décret habilitait la province à prendre possession de la terre et prévoyait que [TRADUCTION] « l’administration et le contrôle de cette terre passent » à la Couronne du chef de la province. La ville d’Oliver voit au fonctionnement et à l’entretien du canal.
En 1996, l’appelante a adopté des règlements relatifs à l’évaluation foncière et à l’impôt foncier en vertu de l’art. 83 de la Loi sur les Indiens. Se fondant sur l’exposé conjoint des faits présenté par le Osoyoos Indian Band Board of Review, le juge siégeant en chambre a conclu que les terres ne pouvaient pas être assujetties à une évaluation foncière par l’appelante. La Cour d’appel a rejeté à la majorité l’appel interjeté par l’appelante.
