The appellant, Jessy Jasinder Garcha, applies for an order, pursuant to s. 70 of the Supreme Court Act, R.S.C. 1985, c. S-26, as am., reversing the judgment of the Court of Appeal for British Columbia dated March 10, 2000, which upheld the judgment of the Honourable Mr. Justice Catliff of the Supreme Court of British Columbia, dated November 2, 1998. By that judgment, the appellant was convicted on sixteen counts of an Indictment that included, as Count Eight, a charge that the appellant had used an imitation firearm on or about the 30th day of December, 1995, while committing or attempting to commit the indictable offence of robbery, contrary to s. 85(2) of the Criminal Code of Canada, R.S.C. 1985, c. C-46. For this conviction, on November 4, 1998, the appellant was sentenced to a term of incarceration of one year, consecutive to all other sentences.
The appellant brings the motion under s. 70 on the basis that s. 85(2) of the Criminal Code creating the offence charged in Count Eight was not yet proclaimed in force on December 30, 1995.
Upon reading the materials filed by the parties, including the affidavit of Jeffrey R. Ray affirmed the 24th day of October, 2000, and the consent of the respondent to a reversal of judgment pursuant to s. 70 of the Supreme Court Act, acquitting the appellant of the charge set out in Count Eight of the Indictment;
It is hereby ordered that:
The portion of the judgment of the Court of Appeal for British Columbia dated March 10, 2000 dismissing the appellant’s appeal from his conviction on Count Eight for use of an imitation firearm on or about the 30th day of December, 1995, while committing or attempting to commit the indictable offence of robbery, contrary to s. 85(2) of the Criminal Code of Canada, R.S.C. 1985, c. C-46, is reversed and an acquittal of the charge in Count Eight is entered in substitution thereof. The sentence of the appellant is varied by deleting the committal of the appellant on Count Eight for a term of one year consecutive to all other sentences.

L’appelant, Jessy Jasinder Garcha, sollicite, conformément à l’art. 70 de la Loi sur la Cour suprême, L.R.C. 1985, ch. S-26 et ses modifications, une ordonnance cassant l’arrêt du 10 mars 2000 dans lequel la Cour d’appel de la Colombie-Britannique a confirmé le jugement du juge Catliff de la Cour suprême de la Colombie-Britannique, rendu le 2 novembre 1998. Dans ce jugement, l’appelant avait été reconnu coupable relativement à 16 chefs d’accusation, dont le huitième selon lequel il était accusé d’avoir, le 30 décembre 1995 ou vers cette date, utilisé une fausse arme à feu lors de la perpétration ou de la tentative de perpétration de l’acte criminel de vol qualifié, en violation du par. 85(2) du Code criminel du Canada, L.R.C. 1985, ch. C-46. À la suite de cette déclaration de culpabilité, l’appelant s’est vu infliger, le 4 novembre 1998, une peine d’emprisonnement d’un an à purger consécutivement à toutes les autres peines.
L’appelant présente la requête fondée sur l’art. 70, en faisant valoir que le par. 85(2) du Code criminel créant l’infraction reprochée dans le huitième chef d’accusation n’avait pas encore été proclamé en vigueur le 30 décembre 1995.
Après avoir pris connaissance de la documentation présentée par les parties, y compris l’affidavit souscrit par Jeffrey R. Ray le 24 octobre 2000, et du consentement de l’intimée à la délivrance d’une ordonnance cassant le jugement conformément à l’art. 70 de la Loi sur la Cour suprême et acquittant l’appelant relativement au huitième chef d’accusation;
Il est, par les présentes, ordonné ce qui suit:
La partie de l’arrêt du 10 mars 2000, dans laquelle la Cour d’appel de la Colombie-Britannique a rejeté l’appel de l’appelant contre sa déclaration de culpabilité relative au huitième chef d’accusation selon lequel il était accusé d’avoir, le 30 décembre 1995 ou vers cette date, utilisé une fausse arme à feu lors de la perpétration ou de la tentative de perpétration de l’acte criminel de vol qualifié, en violation du par. 85(2) du Code criminel du Canada, L.R.C. 1985, ch. C-46, est cassée et remplacée par l’inscription d’un acquittement relatif au huitième chef d’accusation. La peine infligée à l’appelant est modifiée par la suppression de la peine d’emprisonnement d’un an à purger consécutivement à toutes les autres peines.
