Coram: The Chief Justice and L'Heureux‐Dubé, Gonthier, Iacobucci, Major, Bastarache, Binnie, Arbour and LeBel JJ.
The appeal from the judgment of the Court of Appeal for Ontario, Number C33149, dated September 1, 2000, heard on April 23, 2002 is dismissed. The phrase in s. 515(10)(c) of the Criminal Code that permits the denial of bail “on any other just cause being shown and, without limiting the generality of the foregoing,” is unconstitutional and should be severed from the paragraph. The portion of the paragraph that permits a judge to deny bail “where the detention is necessary in order to maintain confidence in the administration of justice ...” is constitutionally valid. Iacobucci, Major, Arbour and LeBel JJ. are dissenting.
The constitutional questions are answered as follow:
1. Does s. 515(10)(c) of the Criminal Code, R.S.C. 1985, c. C-46, infringe s. 11(e) of the Canadian Charter of Rights and Freedoms?
Answer: Yes, in part. The phrase “on any other just cause being shown and, without limiting the generality of the foregoing” infringes s. 11(e) of the Canadian Charter of Rights and Freedoms. Iacobucci, Major, Arbour and LeBel JJ. would answer yes.
2. If Question 1 is answered affirmatively, is the infringement demonstrably justified in a free and democratic society pursuant to s. 1 of the Canadian Charter of Rights and Freedoms?
Answer: No.
L'appel contre l'arrêt de la Cour d'appel de l'Ontario, numéro C33149, en date du 1er septembre 2000, entendu le 23 avril 2002 est rejeté. La partie de l’al. 515(10)c) du Code criminel qui permet de refuser d’accorder la mise en liberté sous caution « [s’]il est démontré une autre juste cause et, sans préjudice de ce qui précède, » est inconstitutionnelle et doit être dissociée de l’alinéa. La partie qui permet au juge de refuser d’accorder la mise en liberté sous caution lorsque « [l]a détention est nécessaire pour ne pas miner la confiance du public dans l’administration de la justice » est constitutionnelle. Les juges Iacobucci, Major, Arbour et LeBel sont dissidents.
Les questions constitutionnelles reçoivent les réponses suivantes:
1. L’alinéa 515(10)c) du Code criminel, L.R.C. 1985, ch. C‐46, viole‐t‐il l’al. 11e) de la Charte canadienne des droits et libertés?
Réponse : Oui, en partie. Les mots «il est démontré une autre juste cause et, sans préjudice de ce qui précède» violent l’al. 11e) de la Charte canadienne des droits et libertés. Les juges Iacobucci, Major, Arbour et LeBel répondraient oui.
2. Si la réponse à la première question est affirmative, la justification de cette violation peut‐elle se démontrer dans le cadre d’une société libre et démocratique, conformément à l’article premier de la Charte canadienne des droits et libertés?
Réponse : Non.
