International Law - Sovereign Immunity - Republic of Germany requested extradition of Appellant from Canada - Appellant arrested and detained in Canada - Appellant brought action for damages for personal injuries in the form of mental distress, denial of liberty and damage to reputation - Legislation conferring immunity on foreign states from jurisdiction of Canadian courts - Whether the Court of Appeal erred in holding that the term “personal injury” in s. 6(a) of the State Immunity Act applies only to claims of physical injury, and does not apply to wrongful imprisonment - Whether the exception in s. 4(2)(b) of the State Immunity Act applies.
The Appellant is a businessman and a Canadian citizen. In May, 1999, a court in Augsburg, Germany issued a warrant for the Appellant’s arrest. In August, 1999, Germany requested Canada, under the Extradition Treaty that exists between the two countries, to provisionally arrest the Appellant in order that he might be extradited to Germany in relation to tax evasion and other offences. An official in the International Assistance Group of the Department of Justice authorized the Attorney General to apply to a judge under s. 13 of the Extradition Act, S.C. 1999, c. 18 for a provisional arrest warrant. Pursuant to a provisional arrest warrant issued, the Appellant was arrested by the Royal Canadian Mounted Police. The Appellant then spent the next eight days in jail until he was released on bail. The Appellant commenced an action against the Respondents seeking damages in the amount of $1 million for personal injuries suffered as a result of his arrest and detention in Canada. The Respondent, The Federal Republic of Germany brought a motion to have the action dismissed on the grounds that it does not have the legal capacity to be sued by the Appellant because it enjoys sovereign immunity by virtue of the State Immunity Act, R.S.C. 1985, c. S-18. The Superior Court of Justice dismissed the Appellant’s claim against The Federal Republic of Germany and stayed the action against the Attorney General of Canada. The Appellant’s appeal to the Court of Appeal for Ontario on the issue of the dismissal of the claim against The Federal Republic of Germany was dismissed by a unanimous court.

L’appelant est un homme d’affaires et un citoyen canadien. En mai 1999, un tribunal à Augsbourg, en Allemagne, a décerné un mandat d’arrestation contre l’appelant. En août 1999, l’Allemagne a demandé au Canada, aux termes du traité d’extradition qui existe entre les deux pays, d’arrêter provisoirement l’appelant pour que celui‑ci puisse être extradé vers l’Allemagne relativement à des infractions de fraude fiscale et autres. Un fonctionnaire du Groupe d’entraide internationale du ministère de la Justice a autorisé le procureur général à présenter une demande à un juge, en vertu de l’art. 13 de la Loi sur l’extradition, L.C. 1999, ch. 18, en vue d’obtenir un mandat d’arrestation provisoire. Conformément au mandat d’arrestation provisoire décerné, la Gendarmerie royale du Canada a arrêté l’appelant. L’appelant a passé les huit jours suivant en prison, après quoi il a été mis en liberté sur cautionnement. Il a intenté une action contre les intimés dans laquelle il réclamait des dommages‑intérêts au montant de 1 million de dollars pour les dommages corporels subis en raison de son arrestation et de sa détention au Canada. L’intimée, la République fédérale d’Allemagne, a présenté une requête en vue d’obtenir le rejet de l’action au motif qu’elle n’a pas la capacité juridique requise pour être poursuivie par l’appelant, et ce, parce qu’elle jouit d’une immunité de juridiction en vertu de la Loi sur l’immunité des États, L.R.C. 1985, ch. S-18. La Cour supérieure de justice a rejeté l’action qu’a intentée l’appelant contre la République fédérale d’Allemagne et a suspendu l’action contre le procureur général du Canada. La Cour d’appel de l’Ontario a rejeté à l’unanimité l’appel qu’a interjeté l’appelant relativement au rejet de l’action contre la République fédérale d’Allemagne.
