CORAM: The Chief Justice and L'Heureux‑Dubé, Gonthier, Iacobucci, Major, Bastarache, Binnie, Arbour and LeBel JJ.
The appeal is allowed. The decision of the trial judge is restored. The constitutional questions are answered as follows:
1. Is s. 27 of the Marine Mammal Regulations, SOR/93-56, within the legislative authority of the Parliament of Canada as being legislation pertaining to the sea coast and inland fisheries under s. 91(12) of the Constitution Act, 1867?
Answer: Yes.
2. Is s. 27 of the Marine Mammal Regulations within the legislative authority of the Parliament of Canada as being legislation pertaining to the criminal law under s. 91(27) of the Constitution Act, 1867?
Answer: No.
L’appel est accueilli. La décision du juge de première instance est rétablie. Les questions constitutionnelles reçoivent les réponses suivantes:
1. L’article 27 du Règlement sur les mammifères marins, DORS/93-56, relève-t-il de l’autorité législative du Parlement du Canada en tant que mesure législative relative aux pêcheries des côtes de la mer et de l’intérieur en vertu du par. 91(12) de la Loi constitutionnelle de 1867?
Réponse: Oui.
2. L’article 27 du Règlement sur les mammifères marins relève-t-il de l’autorité législative du Parlement du Canada en tant que mesure législative relative au droit criminel en vertu du par. 91(27) de la Loi constitutionnelle de 1867?
Réponse: Non.

The appeal is allowed and the jury award of $1 million in punitive damages is restored, with costs in this Court and the Court of Appeal on a party and party basis, LeBel J. dissenting.
The respondent’s cross-appeal against the award of any punitive damages is dismissed, with costs to the appellant, also on a party and party basis.
L’appel est accueilli et la somme de un million de dollars accordée par le jury au titre des dommages-intérêts punitifs est rétablie, avec dépens devant notre Cour et devant la Cour d’appel sur la base partie-partie. Le juge LeBel est dissident.
L’appel incident de l’intimée contestant l’attribution de toute somme au titre des dommages-intérêts punitifs est rejeté avec dépens en faveur de l’appelante, également sur la base partie-partie.
