Commercial law - Insurance - Automobile insurance - Statutory provision relating to underinsured coverage restricted to situations where “claimant is legally entitled to recover” - Agreement with tortfeasor to sue only to extent of insurance coverage - Whether claimant legally entitled to recover under underinsured provisions of own policy.
The Respondents Pearl and Gwendolyn Somersall sustained serious bodily injury in a motor vehicle accident. They issued a statement of claim against the other driver (Friedman) and the Respondent Janice Somersall joined the action to claim damages under the Family Law Act, R.S.O. 1990, c. F.3, on her own behalf and on behalf of other family members. Following an exchange of correspondence, an agreement was concluded between the Respondents’ solicitor and Friedman’s solicitor. It provided that: (1) Friedman would admit liability for the accident at trial; and, (2) the Respondents would not make a claim against Friedman or his insurer in excess of Friedman’s insurance policy limits. The Respondents added their own insurer, the Appellant, as a defendant to the action. The Appellant filed a statement of defence and cross-claimed against Friedman. Counsel for the Appellant moved pursuant to Rule 21.01 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194, for determination before trial of the following question of law:
Does the agreement reached between counsel for [the Respondents] and counsel for the defendant Friedman limiting the [Respondents’] claim to that defendant’s policy limits preclude the [Respondents] from advancing a claim against [the Appellant] pursuant to the underinsured Motorist Provisions of its policy?
The Respondents’ claim was pursuant to the underinsured coverage provisions, the S.E.F. 44 Family Protection Endorsement, contained in an Ontario Standard Automobile Policy issued to the Respondent Pearl Somersall. This provision provided that the insurer was obligated to
indemnify each eligible claimant for the amount that such eligible claimant is legally entitled to recover from an inadequately insured motorist as compensatory damages in respect of bodily injury or death sustained by an insured person by accident arising out of the use or operation of an automobile.
Speigel J. dismissed the Respondents’ action against the Appellant. The Court of Appeal allowed their appeal from this decision.

Les intimées Pearl et Gwendolyn Somersall ont subi un grave préjudice corporel dans un accident automobile. Elles ont déposé une déclaration contre l’autre conducteur (Friedman), et l’intimée Janice Somersall s’est jointe à l’action pour réclamer des dommages‑intérêts en vertu de la Loi sur le droit de la famille, L.R.O. 1990, ch. F.3, pour son propre compte et pour celui d’autres membres de la famille. À la suite d’un échange de lettres, une entente a été conclue entre l’avocat des intimées et celui de Friedman. L’entente prévoyait : (1) Friedman admettrait sa responsabilité quant à l’accident au procès; et, (2) les intimées ne feraient pas de réclamation contre Friedman ou son assureur pour ce qui excède la limite d’assurance de Friedman. Les intimées ont ajouté leur propre assureur, l’appelante, comme partie défenderesse à l’action. L’appelante a déposé une défense et a présenté une demande reconventionnelle contre Friedman. L’avocat de l’appelante a présenté une motion en vertu de la règle 21.01 des Règles de procédure civile, R.R.O. 1990, Règl. 194, pour que la question de droit suivante soit tranchée avant l’instruction :
[Traduction] L’entente conclue entre l’avocat des [intimées] et celui du défendeur Friedman qui restreint la réclamation [des intimées] à la limite stipulée dans la police du défendeur Friedman empêche-t-elle [les intimées] de présenter une réclamation contre [l’appelante] en vertu des clauses de protection de leur police contre les automobilistes insuffisamment assurés?
La réclamation des intimées est fondée sur les clauses de protection contre les automobilistes insuffisamment assurés, l’assurance familiale (S.E.F. 44), contenues dans l’Ontario Standard Automobile Policy délivrée à l’intimée Pearl Somersall. Suivant cette clause, l’assureur a l’obligation suivante :
[Traduction] indemniser chaque demandeur admissible du montant qu’il a le droit de réclamer d’un automobiliste insuffisamment assuré à titre de dommages‑intérêts compensatoires pour le préjudice corporel subi par l’assuré ou pour le décès de celui‑ci par suite de l’usage ou de la conduite d’une automobile.
Le juge Speigel a rejeté l’action des intimées contre l’appelante. La Cour d’appel a fait droit à leur appel de cette décision.
