The appeal from the judgment of the Court of Appeal of British Columbia (Vancouver), Number CA026500, dated March 7, 2001, heard on October 2, 2002 is allowed with costs throughout to the appellant. The record, including personal documents and therapeutic records will remain sealed in all courts. The judgments of this Court and the courts below remain public. Publication of the complainant’s name and any facts or other names that would reveal her identity are banned. The issue of whether the respondent’s name should be disclosed is to be decided by the College of Physicians and Surgeons of British Columbia in accordance with its normal practices.
L’appel interjeté contre l’arrêt de la Cour d’appel de la Colombie‑Britannique (Vancouver), numéro CA026500, en date du 7 mars 2001, entendu le 2 octobre 2002 est accueilli avec dépens en faveur de l’appelant dans toutes les cours. Le dossier, y compris tout document personnel et tout dossier thérapeutique, demeurera scellé dans notre Cour et dans les cours d’instance inférieure. Les jugements émanant de notre Cour et des cours d’instance inférieure demeureront publics. Il est interdit de publier le nom de la plaignante ainsi que tout fait ou autre nom susceptible de révéler son identité. C’est au Collège des médecins et chirurgiens de décider, suivant la pratique usuelle, si l’identité de l’intimé devrait être divulguée.

The appeal from the judgment of the Court of Appeal of New Brunswick, Number 226/2000/CA, dated April 5, 2001, heard on October 1, 2002 is allowed with costs throughout to the appellant. The judgment of the New Brunswick Court of Appeal is set aside and the order of the Discipline Committee of the Law Society of New Brunswick is restored.
L’appel interjeté contre l’arrêt de la Cour d’appel du Nouveau-Brunswick, numéro 226/2000/CA, en date du 5 avril 2001, entendu le 1er octobre 2002 est accueilli avec dépens dans toutes les cours, l’arrêt de la Cour d’appel du Nouveau-Brunswick est annulé et l’ordonnance du comité de discipline du Barreau du Nouveau-Brunswick est rétablie.
