Criminal law - Constitutional law - Native law - Métis - Hunting rights -Métis convicted of hunting on unoccupied Crown land in an area where hunting was prohibited - Whether Appellant, as a Métis person, falls within the constitutional meaning of the term “Indian” under s. 13 of the Natural Resources Transfer Agreement (“NRTA”)- Whether s. 26 of Manitoba’s The Wildlife Act is inapplicable in respect to the Appellant, and of no force or effect to the extent that it infringes or limits the Appellant’s right to hunt for food for himself and his family under s. 13 of the NRTA.
The facts are taken from an agreed statement of facts filed at trial and filed as an exhibit in and quoted by the Court of Appeal. The Appellant and two other men were hunting for deer for food for themselves and their immediate families on unoccupied Crown land on February 10, 1994. The hunting of deer on that date in that area was prohibited by the terms of the Wildlife Regulations passed pursuant to The Wildlife Act, C.C.S.M., c. W130. All parties agreed, and the trial judge found, that the Appellant is a Métis within the meaning of s. 35 of the Constitution Act, 1982.
The Appellant and his co-accused were charged and convicted of the summary conviction offence of unlawfully hunting deer out of season contrary to s. 26 of The Wildlife Act. The Appellant alone appealed his conviction to the Manitoba Court of Queen’s Bench. The appeal was dismissed in September 1998. An appeal to the Court of Appeal was dismissed.

Droit criminel - Droit constitutionnel - Droit relatif aux Autochtones - Métis - Droits de chasse -Métis déclaré coupable d’avoir chassé sur des terres domaniales inoccupées à un endroit où cette activité était interdite - En tant que Métis, l’appelant est-il visé par le terme « Indiens » figurant à l’article 13 de la Convention sur le transfert des ressources naturelles (la « Convention ») - L’article 26 de la Loi sur la conservation de la faune,C.P.L.M., ch. W130, du Manitoba est-il inapplicable à l’égard de l’appelant et sans effet à son endroit dans la mesure où il limite le droit de l’appelant de chasser, en vertu de l’art. 13 de la Convention, pour se nourrir et nourrir sa famille, ou porte atteinte à ce droit.
Les faits sont tirés de l’exposé des faits qui a été produit au procès, puis déposé comme pièce devant la Cour d’appel et cité par celle-ci. Le 10 février 1994, l’appelant et deux autres hommes chassaient le cerf sur des terres domaniales inoccupées dans le but de se nourrir et de nourrir leurs familles immédiates. À cette date, la chasse au cerf était interdite par un règlement d’application de la Loi sur la conservation de la faune. Les parties conviennent toutes que l’appelant est un Métis au sens de l’art. 35 de la Loi constitutionnelle de 1982 , conclusion qu’a d’ailleurs tirée le juge du procès.
L’appelant et son co-accusé ont été inculpés et déclarés coupables, par procédure sommaire, d’avoir illégalement chassé le cerf pendant une période d’interdiction, contravenant ainsi à l’art. 26 de la loi sur la conservation de la faune. L’appelant a interjeté appel à la Cour du Banc de la Reine du Manitoba de sa déclaration de culpabilité. Cet appel a été rejeté en septembre 1998. L’appel qu’il a ensuite introduit en Cour d’appel a lui aussi été rejeté.
