Thomas Robert Zinck v. Her Majesty the Queen (N.B.)(Crim.)(28367)
28367 Thomas Robert Zinck v. Her Majesty The Queen
Criminal law - Sentencing - Order for delayed parole - Whether the New Brunswick Court of Appeal erred in law in holding that the imposition of an order pursuant to s. 743.6 (1) of the Criminal Code on the Appellant was justified - Whether the Court of Appeal erred in law in holding that the Appellant was not denied procedural fairness in the imposition of the order.
The Appellant was charged with second‑degree murder in the killing of 19-year-old Stéphane Caissie. According to the judgment of the Court of Appeal, the crime occurred at a house where there had been several break and enters. The Appellant, who was drinking heavily the day of the incident and does not recall the event, arrived at the Caissie home late at night and began to yell and bang at the door. When the victim opened the door, the Appellant shot him in the face with a single shot from a shotgun. Caissie died instantly. The Appellant threw away the spent cartridge, left his shotgun at the scene and went to a nearby residence, informing the occupant that he had just shot Caissie in the head. The neighbour called the police. The Appellant pleaded guilty to the included offence of manslaughter. The trial judge sentenced the Appellant to 12 years’ imprisonment, with the restriction that he serve at least one‑half of the term before being eligible to apply for parole. The Court of Appeal granted leave to appeal the sentence and dismissed the appeal.
