The appeal from the judgment of the Court of Appeal of Manitoba, Number AR01‑30‑05120, dated September 25, 2002, heard on March 26, 2004 is allowed, the judgment of the Court of Appeal is set aside and the acquittal is restored, Bastarache and Deschamps JJ. dissenting.
L’appel interjeté contre l’arrêt de la Cour d’appel du Manitoba, numéro AR01‑30‑05120, en date du 25 septembre 2002, entendu le 26 mars 2004 est accueilli, le jugement de la Cour d’appel est annulé et l’acquittement est rétabli. Les juges Bastarache et Deschamps sont dissidents.
