The appeal from the judgment of the Court of Appeal of Quebec (Montreal), Number 500‑09‑008724‑999, dated August 28, 2001, heard on November 4, 2003 is dismissed without costs, except as regards the amicus curiae whose costs will be paid in accordance with the order rendered upon its appointment.
L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Montréal), numéro 500‑09‑008724‑999, en date du 28 août 2001, entendu le 4 novembre 2003 est rejeté sans dépens, sauf quant à l’amicus curiae dont les frais seront payés conformément à l’ordonnance prononcée lors de sa désignation.

L’appel interjeté contre l’arrêt de la Cour d’appel du Québec (Montréal), numéro 500‑09‑009865‑007, en date du 1er mars 2002, entendu le 9 décembre 2003 est accueilli en partie, pour ajouter au dispositif de l’arrêt de la Cour d’appel une conclusion ordonnant à la Ville de Montréal de réexaminer la candidature de M. Larocque, conformément aux règles d’embauche de ses policiers municipaux maintenant en vigueur, mais sans tenir compte de sa perte de capacité auditive. Vu le résultat de l’appel, l’appelante a droit à ses dépens devant la Cour.
The appeal from the judgment of the Court of Appeal of Quebec (Montreal), Number 500‑09‑009865‑007, dated March 1, 2002, heard on December 9, 2003 is allowed in part, adding to the Court of Appeal’s disposition an order compelling the City of Montréal to reconsider Mr. Larocque’s application in accordance with the rules for hiring police officers currently in force, but without taking into account his hearing loss. Given the outcome of this appeal, costs in this Court are awarded to the Appellant.

On this day reasons were delivered and the judgment was restated as follows:
The appeal is dismissed and the decision of the Ontario Court of Appeal is confirmed. There is no order for costs as against the parties before this Court. Any order of costs pertaining to the judicial review should properly be considered by the Divisional Court undertaking the review.

Le pourvoi est rejeté et la décision de la Cour d’appel de l’Ontario est confirmée. Aucune ordonnance n’est rendue à l’égard des dépens devant notre Cour. Il incombera à la Cour divisionnaire de rendre toute ordonnance qu’elle jugera appropriée en ce qui concerne les dépens afférents à la révision judiciaire dont elle sera saisie.
