The appeal from the judgment of the Federal Court of Appeal, Numbers A‐806‐99, A‐807‐99, A‐808‐99, dated May 14, 2002, heard on November 10, 2003 is allowed. The cross-appeal is dismissed. Given the appellant’s success on the appeal and cross-appeal, it is entitled to costs throughout.
L’appel interjeté contre l’arrêt de la Cour d’appel fédérale, numéros A‐806‐99, A‐807‐99, A‐808‐99, en date du 14 mai 2002, entendu le 10 novembre 2003 est accueilli. L’appel incident est rejeté. L’appelant ayant gain de cause dans le cadre de l’appel principal et de l’appel incident, les dépens lui sont adjugés devant toutes les cours.
