Criminal law - Sentencing - Principles of sentencing under Youth Criminal Justice Act, S.C. 2002, c. 1 - Is general deterrence a principle to be considered in imposing a sentence under the Youth Criminal Justice Act?
The Appellant was charged with aggravated assault under the Youth Criminal Justice Act, S.C. 2002, c. 1. The charges arose from an incident in which one of his customers (the Appellant was a drug dealer) was beaten by the Appellant and his co-accused. The complainant was also stabbed by the Appellant’s co-accused.
During his trial, the Appellant entered a guilty plea to assault causing bodily harm. He was sentenced to 9 months in custody followed by a 15-month intensive support and supervision program. The Appellant appealed his sentence to the British Columbia Court of Appeal. His application for leave to appeal sentence was allowed, and the appeal was allowed in part, with the conditions imposed on the community supervision portion of the Custody and Supervision Order being deleted.

Droit criminel - Détermination de la peine - Principes de détermination de la peine applicables à l’égard de la Loi sur le système de justice pénale pour adolescents, L.C. 2002, ch. 1 - La dissuasion générale est-elle un principe qui doit être pris en compte dans la détermination d’une peine en vertu de la Loi sur le système de justice pénale pour adolescents ?
L’appelant a été accusé de voies de fait graves en vertu de la Loi sur le système de justice pénale pour les adolescents. Les accusations faisaient suite à un événement au cours duquel l’appelant (trafiquant de drogue) et son coaccusé avaient battu un des clients du premier. Le plaignant a également été poignardé par le coaccusé.
Au procès, l’appelant a plaidé coupable à l’accusation de voies de fait causant des lésions corporelles. Il a été condamné à une période de placement sous garde de 9 mois, suivie d’un programme d’assistance et de surveillance intensives de 15 mois. Il a fait appel de la peine à la Cour d’appel de la Colombie-Britannique. Celle-ci lui a accordé l’autorisation de faire appel et a fait droit en partie à son appel, supprimant les conditions dont était assortie la période de surveillance au sein de la collectivité prévue par l’ordonnance de placement et de surveillance,.

Criminal law - Sentencing - Principles of sentencing under Youth Criminal Justice Act, S.C. 2002, c. 1 - Is general deterrence a principle to be considered in imposing a sentence under the Youth Criminal Justice Act? - Whether Court of Appeal erred in holding that deterrence may not be considered in sentencing under the Youth Criminal Justice Act - Whether Court of Appeal erred in principle in its interpretation of Section 42(2)(o) of the Youth Criminal Justice Act.
The Respondent, an aboriginal young person, was convicted of manslaughter and theft following a plea of guilty. The manslaughter occurred during a fight with the deceased. The Respondent was intoxicated and had swung a stocking‐covered pool ball at the victim's head during a fight. The theft charges related to stolen speakers.
Although charged under the Young Offenders Act, the Appellant was sentenced under the Youth Criminal Justice Act, S.C. 2002, c. 1. He had a previous youth record, but it was minor. In sentencing the Respondent, the sentencing judge noted that he had reduced his use of alcohol intake since the incidents had occurred. There was a risk assessment that determined he was at a low risk to re‐offend. He had stable family support. The Respondent had accepted responsibility for his actions and had shown remorse. While on judicial interim release, he had breached his curfew once. The Respondent was sentenced to a custody and supervision order for 15 months, followed by one year of supervised probation. The custodial portion of the order was one day, and the remainder of his sentence was to be served under conditional supervision in the community. The sentencing judge determined that the offence of manslaughter committed by the Respondent was a serious violent offence under the Youth Criminal Justice Act. The Appellant Crown appealed the sentence to the Court of Appeal for Manitoba. The appeal was dismissed.

Droit criminel - Principes de détermination de la peine applicables à l’égard de la Loi sur le système de justice pénale pour adolescents L.C. 2002, ch. 1 - La dissuasion générale est-elle un principe qui doit être pris en compte dans la détermination d’une peine en vertu de la Loi sur le système de justice pénale pour adolescents? - La Cour d’appel a-t-elle fait erreur en décidant que ce principe ne pouvait pas être pris en compte? - La Cour d’appel a-t-elle commis une erreur de principe dans son interprétation de l’al. 42(2)o) de la Loi sur le système de justice pénale pour adolescents?
L’intimé, un jeune Autochtone, a plaidé coupable à des accusations d’homicide involontaire coupable et de vol. L’homicide involontaire coupable a été commis au cours d’une bataille : l’intimé était ivre et il a assené à la victime un coup à la tête au moyen d’une bille de billard qui avait été insérée dans une chaussette. Les accusations de vol portaient sur des haut-parleurs.
L’intimé a été accusé en vertu de la Loi sur les jeunes contrevenants, mais a été condamné en application de la Loi sur le système de justice pénale pour adolescents. Il était encore adolescent, mais il avait déjà été reconnu coupable d’une infraction en vertu de la Loi sur les jeunes contrevenants. Lors de la détermination de la peine, le juge a indiqué que l’intimé avait diminué sa consommation d’alcool depuis les événements. L’évaluation du risque avait permis de déterminer que le risque de récidive de la part de l’intimé était peu élevé. Il avait le soutien d’une famille stable. Il avait reconnu sa responsabilité et manifesté du remords pour les actes reprochés. Durant sa mise en liberté provisoire par voie judiciaire, il avait violé son couvre-feu une fois. L’intimé a été condamné à une ordonnance de placement et de surveillance de 15 mois suivie d’une année de probation sous surveillance. Le période de placement prévue par l’ordonnance était d’une journée, et le reste de la peine devait être purgé sous surveillance au sein de la collectivité. Le juge de la peine a déterminé que l’homicide involontaire coupable qu’avait commis l’intimé était une infraction grave avec violence au sens de la Loi sur le système de justice pénale pour adolescents. L’appelante a interjeté appel de la peine à la Cour d’appel du Manitoba. L’appel a été rejeté.
